ADOPTING ORDINANCE NO. 116-84
AN ORDINANCE OF THE CITY OF SHEFFIELD LAKE, OHIO, TO APPROVE, ADOPT AND ENACT THE RECODIFICATION OF THE CITY ORDINANCES; TO REPEAL ORDINANCES IN CONFLICT THEREWITH; TO PUBLISH THE ENACTMENT OF NEW MATTER, AND DECLARING AN EMERGENCY.
   WHEREAS, the Council of the City of Sheffield Lake, Ohio, has had the matter of recodification and general revision of the City ordinances before it for some time, and
   WHEREAS, the City has heretofore entered into a contract with the Walter H. Drane Company to prepare and publish such recodification, and
   WHEREAS, the recodification of such ordinances, together with the new matter to be adopted, the matters to be amended and those to be repealed are before the Council,
   NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF SHEFFIELD LAKE, STATE OF OHIO:
   Section 1. The ordinances of the City of Sheffield Lake, Ohio, of a general and permanent nature, as codified, arranged and consolidated into component codes, titles, chapters and sections are hereby approved, adopted and enacted as the Codified Ordinances of Sheffield Lake, Ohio, 1984.
   One book-form copy of the Codified Ordinances shall be certified as correct by the Mayor and the Clerk of Council, attached to this ordinance as a part hereof, and filed with the permanent ordinance records of the City of Sheffield Lake, Ohio.
   Section 2. All ordinances and resolutions or parts thereof which are inconsistent or in conflict with any provision of the Codified Ordinances are hereby repealed as of the effective date of this ordinance, except as follows:
   (a)    The enactment of the Codified Ordinances shall not be construed to affect a right or liability accrued or incurred under any legislative provisions prior to the effective date of such enactment, or an action or proceeding for the enforcement of such right or liability. Such enactment shall not be construed to relieve any person from punishment for an act committed in violation of any such legislative provision, nor to affect an indictment or prosecution therefor. For such purposes any such legislative provision shall continue in full force notwithstanding its repeal for the purpose of revision and recodification.
   (b)    The repeal provided above shall not affect:
      (1)    The grant or creation of a franchise, license, right, easement or privilege.
      (2)    The purchase, sale, lease or transfer of property.
      (3)    The appropriation or expenditure of money or promise or guarantee of payment.
      (4)    The assumption of any contract or obligation.
      (5)    The issuance and delivery of any bonds, obligations or other instruments of indebtedness.
      (6)    The levy or imposition of taxes, assessments or charges.
      (7)    The establishment, naming, vacating or grade level of any street or public way.
      (8)    The dedication of property or plat approval.
      (9)    The annexation or detachment of territory.
(10)    Any legislation enacted subsequent to November 6, 1984.
   Section 3. The Clerk of Council shall post a copy of this Adopting Ordinance along with a copy of the Codified Ordinances in the manner required by Section 113.01 of the Codified Ordinances.
   Section 4. It is found and determined that all formal action of the Council concerning and relating to the adoption of the ordinance were adopted in an open meeting of Council and all deliberations of this Council and any of its committees which result in such formal action, were in meeting open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
   Section 5. This ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public peace, health, safety and welfare of the City of Sheffield Lake for the reason that there exists an imperative necessity for the earliest publication and distribution of the Codified Ordinances to the officials and citizens of the City, so as to facilitate administration, daily operation and avoid practical and legal entanglements, and therefore, this ordinance shall take effect and be in force immediately upon its passage.

EDITOR'S NOTE
   The arrangement and numbering of the Codified Ordinances into component codes, titles, chapters and sections are based on an adaptation of the decimal numbering system which is similar to that used in the Ohio Revised Code, and in accord with the best accepted practice in instituting a codification. Each section is self-identifying as to code, chapter and section number. For example, 305.06 indicates that the code number is 3, the chapter number is 305 (or the 5th chapter within code 3), and the section number is .06. The code and chapter numbers appear left of the decimal, with the code number preceding the first two digits left of the decimal, and the chapter number being all digits left of the decimal. The section number appears right of the decimal. As another example, 113.10 indicates the code number is 1, the chapter number is 113 (or the 13th chapter within code 1), and the section number is .10.
   This numbering system has the advantage of inherent flexibility in allowing for an almost endless amount of expansion. Codes, titles and chapters initially are odd-numbered, thus reserving the use of even numbers for future legislation. Sections within chapters are consecutively numbered, except that penalty provisions are usually assigned the number .99 as used in the Revised Code. Newly created sections subsequent to the original codification may be indicated by three digits right of the decimal in the event the law properly belongs between two consecutively numbered sections. For example, newly created 575.061, 575.062 and 575.063 follow 575.06 and precede 575.07 to be placed in their logical position.
   Section histories enable a user to trace the origin of the law contained in the section. The history indicates the derivation by reference to either its passage date and ordinance number originally assigned to it at that time, or to its inclusion in any prior code. Sections without histories indicate that the section contains new matter which was ordained by the Adopting Ordinance which enacts the Codified Ordinances.
   The Comparative Section Table is included to show the disposition of every ordinance included in the Codified Ordinances. It indicates whether a given ordinance was consolidated with another into one section or split into two or more sections. Cross references direct the user to subject matter reasonably related to material contained within a given chapter.

706.01 DEFINITIONS.
   As used in this chapter:
   (a)    "Physician" means a person licensed to practice medicine and surgery or osteopathic medicine and surgery pursuant to Ohio R.C. 4731.14 or 4731.29.
   (b)    "Hospital" means a general hospital, or a special hospital devoted to gynecology and obstetrics, which is accredited as a hospital by the Joint Commission on Accreditation of Hospitals of the American College of Physicians, The American College of Surgeons, The American Hospital Association and The American Medical Association, or which is accredited as a hospital by The Accreditation Committee of the Office of Hospital Affairs of the American Osteopathic Association.

706.02 STANDARDS AND PROCEDURES.
   An abortion otherwise permitted by law shall be performed only in a hospital or by a licensed physician in a facility which provides the following standards and procedures which must be met and adhered to:
   (a)    Written verification by two physicians, one of whom may be the physician performing the abortion, of the diagnosis of pregnancy and duration of pregnancy shall be made. Both physicians shall be qualified for diagnosis of such condition and shall verify that they have thoroughly examined the patient at least once prior to the performance of the abortion.
   (b)    There shall be a recorded pre-operative history and physical examination particularly directed to identification of pre-existing or concurrent illnesses or drug sensitivities that may have a bearing on the operative procedures or the anesthesia.
   (c)    Laboratory procedures as are usually required for a hospital admission, including blood type and Rh factor, shall be followed.
   (d)    A receiving facility where the patient may be prepared and receive necessary pre- operative medication and observation prior to the procedure shall be provided.
   (e)    An operating room shall be provided which is properly equipped to safely conduct the abortion procedure and to assure the availability on the premises of adequate blood, oxygen, anesthesia, resuscitation equipment and standby ambulance service to handle complications and emergency situations which could occur during the procedure. Proper anesthesia service shall be administered by a licensed physician.
   (g)    A recovery facility shall be provided which is staffed with at least one Registered Nurse in attendance at all times, in which the patient shall be observed for a twenty-four hour post-operative period. Adequate blood transfusion facilities must be so available that an emergency transfusion can be given in this facility at any time within this twenty-four hour period.
   (h)    The facility shall provide pre-operative and post-operative psychological counseling by an individual appropriately qualified in the field of psychology. Written verification shall be submitted of both the pre-operative and post-operative counseling sessions and shall include the patient's reasons for desiring the abortion and alternatives presented to the patient. Such report shall be kept in the permanent records.
   (i)    Written post-operative instructions shall be given the patient and arrangements shall be made for a post-operative follow-up examination within one month after the abortion. Examination by a certified pathologist of all pathological specimens shall be made. Human remains shall be disposed of in a humanitarian, legal and dignified manner.
   (j)    Adequate permanent records shall be kept and a report shall be made to the Lorain County Health Department of the need for administration of antibiotics, blood transfusion, prolongation of the patient's stay, hospital admission and other complications. The physician performing the abortion must file with the Lorain County Health Department an abortion report form for each abortion, which form shall contain a pathological diagnosis of the estimated age of gestation and the height and weight (in grams) of the fetus. This registry shall be maintained by the Health Department and shall include recording by code numbers, the patients who have been aborted and any complications which resulted.
   (k)    The usual informed consent, including the operative permit signed by the pregnant woman and her parents if she is a legal minor, shall be obtained.
   (l)    The external identification and promotion of such facility shall conform to the provisions of the code of ethics of the national professional organizations of those physicians performing services within the facility.
   (m)    All such facilities shall permit periodic inspection by the Lorain County Health Department.
   (n)    The facility shall meet the standards of the Joint Commission on Accreditation of Hospitals which apply to the areas set forth in this section.

CHAPTER 1101
Gemeral Provisions
1101.01   Purpose.

1101.12   Burden of proof.
   1101.01 PURPOSE.
   It is the purpose of this Planning and Zoning Code to promote and protect the public health, safety, comfort, convenience, and general welfare of the people of Sheffield Lake through the establishment of minimum regulations governing the subdivision, development, and use of land. Furthermore, the more specific purpose of this Planning and Zoning Code is to:
   (a)   Implement the plans and policies adopted by the City as it relates to the development of land and improvements;
   (b)   Encourage the most appropriate use of land;
   (c)   Conserve and stabilize the character and the values of the residential, business, industrial and recreational areas and to assure the orderly and beneficial development of these areas;
   (d)   Provide adequate open spaces for light and air;
   (e)   Prevent and fight fires;
   (f)   Prevent undue concentration of population;
   (g)   Lessen congestion on streets;
   (h)   Facilitate adequate but economical provisions for community utilities and facilities such as water, transportation, sewerage, schools, parks and other public requirements; and
   (i)   Improve the quality of life through protection of the City's total environment, including, but not limited to, the prevention of air, water and noise pollution;
   (j)   Avoid the inappropriate subdivision or development of lands and provide for adequate drainage, curbing of erosion, and reduction of flood damage; and
   (k)   Foster a more rational pattern of relationship between agricultural, conservation, residential, business, commercial industrial and institutional uses for the mutual benefit of all.

   1101.02 SHORT TITLE.
   These regulations shall be known and may be cited as the "Planning and Zoning Code of the City of Sheffield Lake" or referred to as the "Planning and Zoning Code" or the "code." This code may also be referred to as Part 11 of the Codified Ordinances of the City of Sheffield Lake, Ohio. (Ord. 26-22. Passed 4-26-22.)
   1101.03 SCOPE AND AUTHORITY.
   (a)   General Authority and Scope.
      (1)   The authority for the preparation, adoption, and implementation of this code is derived from Ohio Revised Code (ORC) Chapters 711 and 713, which permits the adoption of uniform rules and regulations governing the zoning and subdivision of land, and by the Charter of the City of Sheffield Lake.
      (2)   Nothing in this code shall be construed to limit City Council in the exercise of all of the powers to zone or redistrict now or hereafter authorized by the Ohio Constitution, Ohio statutes, or the Charter of the City of Sheffield Lake.
   (b)   References to the Ohio Revised Code or the Ohio Administrative Code. Whenever any provision of this code refers to or cites a section of the Ohio Revised Code (as amended) or the Ohio Administrative Code (as amended), and that section is later amended or superseded, this code shall be deemed amended to refer to the amended section or the section that most nearly corresponds to the superseded section.

CHARTER
FOR THE
 
MUNICIPALITY OF SHEFFIELD LAKE
LORAIN COUNTY, OHIO
PREAMBLE
   We, the people of the Municipality of Sheffield Lake, County of Lorain and State of Ohio, in order to secure ourselves the benefits of Municipal Home Rule and to exercise all the powers of local self-government under the Constitution and Laws of the State of Ohio, do hereby adopt this Charter for our Municipality. The male pronoun or adjective wherever used in this Charter refers to both the male and female unless otherwise specifically indicated. Likewise, the female pronoun or adjective wherever used in this Charter refers to both the male and female unless otherwise specifically indicated. The term two-thirds of the remaining members of Council wherever used in the Charter of the City of Sheffield Lake, Ohio, shall mean and be defined as a majority of the voting members of Council excluding the President of Council plus one additional voting member of Council.

1501.01 ADOPTION.
   There is hereby adopted by the Municipality, the Ohio Fire Code (OFC) updates, revisions, amendments and appendices, as adopted by the Ohio Division of State Fire Marshal, Department of Commerce, as published in Division 1301:7 of the Ohio Administrative Code (OAC). (Ord. 54-08. Passed 7-8-08.)

501.01 DEFINITIONS.
   As used in the Codified Ordinances:
   (a)   "Force" means any violence, compulsion or constraint physically exerted by any means upon or against a person or thing.
   (b)   "Deadly force" means any force that carries a substantial risk that it will proximately result in the death of any person.
   (c)   "Physical harm to persons" means any injury, illness or other physiological impairment, regardless of its gravity or duration.
   (d)   "Physical harm to property" means any tangible or intangible damage to property that, in any degree, results in loss to its value or interferes with its use or enjoyment. "Physical harm to property" does not include wear and tear occasioned by normal use.
   (e)   "Serious physical harm to persons" means any of the following:
      (1)   Any mental illness or condition of such gravity as would normally require hospitalization or prolonged psychiatric treatment;
      (2)   Any physical harm that carries a substantial risk of death;
      (3)   Any physical harm that involves some permanent incapacity, whether partial or total, or that involves some temporary, substantial incapacity;
      (4)   Any physical harm that involves some permanent disfigurement, or that involves some temporary, serious disfigurement;
      (5)   Any physical harm that involves acute pain of such duration as to result in substantial suffering, or that involves any degree of prolonged or intractable pain.
   (f)   "Serious physical harm to property" means any physical harm to property that does either of the following:
      (1)   Results in substantial loss to the value of the property, or requires a substantial amount of time, effort or money to repair or replace;
      (2)   Temporarily prevents the use or enjoyment of the property, or substantially interferes with its use and enjoyment for an extended period of time.
   (g)   "Risk" means a significant possibility, as contrasted with a remote possibility, that a certain result may occur or that certain circumstances may exist.
   (h)   "Substantial risk" means a strong possibility, as contrasted with a remote or significant possibility, that a certain result may occur or that certain circumstances may exist.
   (i)   "Offense of violence" means any of the following:
      (1)   A violation of Ohio R.C. 2903.01, 2903.02, 2903.03, 2903.04, 2903.11, 2903.12, 2903.13, 2903.15, 2903.18, 2903.21, 2903.211, 2903.22, 2905.01, 2905.02, 2905.11, 2905.32, 2907.02, 2907.03, 2907.05, 2909.02, 2909.03, 2909.24, 2911.01, 2911.02, 2911.11, 2917.01, 2917.02, 2917.03, 2917.31, 2917.321, 2919.25, 2921.03, 2921.04, 2921.34, 2923.161, 2903.34(A)(1), 2911.12(A)(1) to (3) or 2919.22(B)(1) to (4), or felonious sexual penetration in violation of former Ohio R.C. 2907.12;
      (2)   A violation of an existing or former municipal ordinance or law of this or any other state or the United States, substantially equivalent to any section listed in subsection (i)(1) hereof;
      (3)   An offense, other than a traffic offense, under an existing or former municipal ordinance or law of this or any other state or the United States, committed, purposely or knowingly, and involving physical harm to persons or a risk of serious physical harm to persons;
      (4)   A conspiracy or attempt to commit, or complicity in committing any offense under subsection (i)(1), (2) or (3) hereof.
      (5)   A violation of division (C) of Ohio R.C. 959.131.
   (j)   (1)   "Property" means any property, real or personal, tangible or intangible, and any interest or license in that property. "Property" includes, but is not limited to, cable television service, other telecommunications service, telecommunications devices, information service, computers, data, computer software, financial instruments associated with computers, other documents associated with computers, or copies of the documents, whether in machine or human readable form, trade secrets, trademarks, copyrights, patents, and property protected by a trademark, copyright, or patent. “Financial instruments associated with computers” include, but are not limited to, checks, drafts, warrants, money orders, notes of indebtedness, certificates of deposit, letters of credit, bills of credit or debit cards, financial transaction authorization mechanisms, marketable securities, or any computer system representations of any of them.
      (2)   As used in this section, “trade secret” has the same meaning as in Ohio R.C. 1333.61, and “telecommunications service” and “information service” have the same meanings as in Ohio R.C. 2913.01.
      (3)   As used in this section, “cable television service”, “computer”, “computer software”, “computer system”, “computer network”, “data”, and “telecommunications device” have the same meanings as in Ohio R.C. 2913.01.
   (k)   "Law enforcement officer" means any of the following:
      (1)   A sheriff, deputy sheriff, constable, police officer of a township or joint police district, marshal, deputy marshal, municipal police officer, member of a police force employed by a metropolitan housing authority under Ohio R.C. 3735.31(D) or State highway patrol trooper;
      (2)   An officer, agent or employee of the State or any of its agencies, instrumentalities or political subdivisions, upon whom, by statute, Charter or ordinance, a duty to conserve the peace or to enforce all or certain laws is imposed and the authority to arrest violators is conferred, within the limits of that statutory duty and authority;
      (3)   A mayor or manager in the mayor’s or manager’s capacity as chief conservator of the peace within the mayor’s or manager’s municipal corporation;
      (4)   A member of an auxiliary police force organized by county, township or municipal law enforcement authorities, within the scope of the member's appointment or commission;
      (5)   A person lawfully called pursuant to Ohio R.C. 311.07 to aid a sheriff in keeping the peace, for the purposes and during the time when the person is called;
      (6)   A person appointed by a mayor pursuant to Ohio R.C. 737.10 as a special patrolling officer during riot or emergency, for the purposes and during the time when the person is appointed;
      (7)   A member of the organized militia of this State or the armed forces of the United States, lawfully called to duty to aid civil authorities in keeping the peace or protect against domestic violence;
      (8)   A prosecuting attorney, assistant prosecuting attorney, secret service officer or municipal prosecutor;
      (9)   A veterans' home police officer appointed under Ohio R.C. 5907.02;
      (10)   A member of a police force employed by a regional transit authority under Ohio R.C. 306.35(Y);
      (11)   A special police officer employed by a port authority under Ohio R.C. 4582.04 or 4582.28;
      (12)   The Senate Sergeant of Arms and or Assistant Sergeant at Arms;
      (13)   A special police officer employed by a municipal corporation at a municipal airport, or other municipal air navigation facility, that has scheduled operations, as defined in Section 119.3 of Title 14 of the Code of Federal Regulations, 14 C.F.R. 119.3, as amended, and that is required to be under a security program and is governed by aviation security rules of the transportation security administration of the United States Department of Transportation as provided in Parts 1542 and 1544 of Title 49 of the Code of Federal Regulations, as amended.
   (l)   "Privilege" means an immunity, license or right conferred by law, or bestowed by express or implied grant, or arising out of status, position, office or relationship, or growing out of necessity.
   (m)   "Contraband" means any property that is illegal for a person to acquire or possess under a statute, ordinance, or rule, or that a trier of fact lawfully determines to be illegal to possess by reason of the property’s involvement in an offense. “Contraband” includes, but is not limited to, all of the following:
      (1)   Any controlled substance, as defined in Ohio R.C. 3719.01, or any device, or paraphernalia;
      (2)   Any unlawful gambling device, or paraphernalia;
      (3)   Any dangerous ordnance or obscene material.
   (n)   “A person is “not guilty by reason of insanity” relative to a charge of an offense only if the person proves, in the manner specified in Ohio R.C. 2901.05, that at the time of the commission of the offense, the person did not know, as a result of a severe mental disease or defect, the wrongfulness of the person’s acts.
   (o)   (1)   A.   Subject to subsection (o)(2) hereof, as used in any section contained in Part Five - General Offenses Code that sets forth a criminal offense, “person” includes all of the following:
            1.   An individual, corporation, business trust, estate, trust, partnership, and association;
            2.   An unborn human who is viable.
         B.   As used in any section contained in Part Five - General Offenses Code that does not set forth a criminal offense, “person” includes an individual, corporation, business trust, estate, trust, partnership and association.
         C.   As used in subsection (o)(1)A. hereof:
            1.   “Unborn human” means an individual organism of the species Homo sapiens from fertilization until live birth.
            2.   “Viable” means the stage of development of a human fetus at which there is a realistic possibility of maintaining and nourishing of a life outside the womb with or without temporary artificial life-sustaining support.
      (2)   Notwithstanding subsection (o)(1)A. hereof, in no case shall the portion of the definition of the term “person” that is set forth in subsection (o)(1)A.2. hereof be applied or construed in any section contained in Part Five - General Offenses Code that sets forth a criminal offense in any of the following manners:
         A.   Except as otherwise provided in subsection (o)(2)A. hereof, in a manner so that the offense prohibits or is construed as prohibiting any pregnant woman or her physician from performing an abortion with the consent of the pregnant woman, with the consent of the pregnant woman implied by law in a medical emergency, or with the approval of one otherwise authorized by law to consent to medical treatment on behalf of the pregnant woman. An abortion that violates the conditions described in the immediately preceding sentence may be punished as a violation of Ohio R.C. 2903.01, 2903.02, 2903.03, 2903.04, 2903.05, 2903.06, 2903.08, 2903.11, 2903.12, 2903.13, 2903.14, 2903.21, or 2903.22, as applicable. An abortion that does not violate the conditions described in the second immediately preceding sentence, but that does violate Ohio R.C. 2919.12, division (B) of Ohio R.C. 2919.13, or Ohio R.C. 2919.151, 2919.17 or 2919.18, may be punished as a violation of Ohio R.C. 2919.12, division (B) of Ohio R.C. 2919.13, or Ohio R.C. 2919.151, 2919.17 or 2919.18, as applicable. Consent is sufficient under this subsection if it is of the type otherwise adequate to permit medical treatment to the pregnant woman, even if it does not comply with Ohio R.C. 2919.12.
         B.   In a manner so that the offense is applied or is construed as applying to a woman based on an act or omission of the woman that occurs while she is or was pregnant and that results in any of the following:
            1.   Her delivery of a stillborn baby;
            2.   Her causing, in any other manner, the death in utero of a viable, unborn human that she is carrying;
            3.   Her causing the death of her child who is born alive but who dies from one or more injuries that are sustained while the child is a viable, unborn human;
            4.   Her causing her child who is born alive to sustain one or more injuries while the child is a viable, unborn human;
            5.   Her causing, threatening to cause, or attempting to cause, in any other manner, an injury, illness or other physiological impairment, regardless of its duration or gravity, or a mental illness or condition, regardless of its duration or gravity, to a viable, unborn human that she is carrying.
   (p)   “School safety zone” consists of a school, school building, school premises, school activity, and school bus.
   (q)   “School”, “school building” and “school premises” have the same meaning as in Ohio R.C. 2925.01.
   (r)   “School activity” means any activity held under the auspices of a board of education of a city, local, exempted village, joint vocational, or cooperative education school district; a governing authority of a community school established under Ohio R.C. Chapter 3314; a governing board of an educational service center; or the governing body of a nonpublic school for which the Ohio Director of Education and Workforce prescribes minimum standards under Ohio R.C. 3301.07.
   (s)   “School bus” has the same meaning as in Ohio R.C. 4511.01.

113.01 POSTING OF ORDINANCES.
   (a)   A succinct summary of each municipal ordinance or resolution shall be published using at least one of the following methods:
      (1)   In a newspaper of general circulation in the municipal corporation;
      (2)   On the official public notice web site;
      (3)   On the web site and social medica account of the municipal corporation.
   Proof of the publication shall be made by affidavit of the proprietor of the newspaper or operator of the official public notice web site, as applicable, and shall be filed with the Clerk of Council.
   (b)   The publication shall contain notice that the complete text of each such ordinance or resolution may be obtained or viewed at the office of the Clerk of Council. The Law Director shall review the summary of an ordinance or resolution published under this section before forwarding it to the Clerk for publication, to ensure that the summary is legally accurate and sufficient.
   (c)   Upon publication of a summary of an ordinance or resolution in accordance with this section, the Clerk of Council shall supply a copy of the complete text of each such ordinance or resolution to any person, upon request. The Clerk shall post a copy of the text at the Clerk’s office.
   (d)   Summaries of ordinances or resolutions shall be published in accordance with this section once a week for two consecutive weeks.

113.02 COPYING FEES FOR LEGISLATION; MINUTES.
   (a)   An individual, corporation or other entity requesting a copy of any minutes of any Council meeting, committee meeting, meeting of any board or commission of the City of any other minutes of the City of copies of any ordinances or resolutions or the City shall, prior to the receipt of such copies, pay a fee of five cents ($.05) per page for each copy received.
   (b)   The Clerk of Council or other City employee designated to make said copies shall have a reasonable amount of time to prepare any copies requested hereunder.
   (c)   The City and its employees, officers, officials, agents and other representatives shall have no obligations to carry out research or investigation to obtain documents unless an appropriate and clear description of the documents being sought is provided by the individual, corporation or other entity seeking copies of documents.

561.01 REMOVAL OF WEEDS BY OWNER OR OCCUPANT; NOTICE.
   (a)   The owner, occupant or person having charge of management of any lot or parcel of land situated within the City, whether the same is improved or unimproved, vacant or occupied, within five days written notice, served upon him in conformity with Ohio R.C. 731.52, shall cut or destroy or cause to be cut or destroyed any weeds, vines or grasses growing upon any such lot or parcel of land and prevent the same from blooming or going to seed or exceeding a height of six inches.
   (b)   Whoever violates or fails to comply with this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. (Ord. 20-82. Passed 3-9-82.)
561.02 CUTTING OF GRASS AND WEEDS BY MUNICIPALITY.
   In the event the property owner does not cut or destroy his grass, weeds or vines, in accordance with Section 561.01, then the Service Director is authorized to cause such grass to be cut and such weeds or vines cut or destroyed. The City shall charge the property owner a fee to cut said grass, weeds or vines, not less than one hundred dollars ($100.00) nor more than two hundred fifty dollars ($250.00), said amount to be determined by the Service Director and to be based on the size of the yard and the amount of time required to perform the work. Said charge shall be billed to the property owner of record or person responsible for said property and certified to the Lorain County Treasurer to be assessed on the property owner’s real estate tax bill.

561.03 ABATEMENT OF NUISANCE BY MUNICIPALITY.
   (a)   Should the Building Inspector or his designee, after the inspection of any lot or parcel of land situated within the City, whether the same is improved or unimproved, vacant or occupied, determine that the lot or parcel of land has upon it weeds, vines, grasses or other growing substances of any type or kind whatsoever or any standing water, litter, rubbish, refuse or other substance of any type or kind whatsoever that is or are not properly upon such lot or parcel of land; or that such lot or parcel of land in any way constitutes a nuisance within the City: The Building Inspector or his designee shall notify the owner, occupant or person having charge or management of the lot or parcel of land of any such condition or nuisance and that such condition or nuisance must be abated; and that such condition of the lot or parcel of land, is found to be in violation of the ordinances or resolutions of the City or of a statute of the State of Ohio; or to constitute a nuisance.
   (b)   Should the owner, occupant or person having charge or management of the lot or parcel of land fail to cause such condition to be remedied or nuisance to be abated within five days of the written notice, the Building Inspector or his designee shall notify the Service Director of such failure.
   (c)   Upon notification of such failure, Service Director shall have the authority to declare that provisions of this section be enforced and shall have the authority to cause the condition or nuisance to be remedied or abated in accordance with Section 561.02.

561.04 NOXIOUS WEEDS AND RANK VEGETATION DEFINED; DECLARATION OF A NUISANCE.
   (a)   Noxious weeds and rank vegetation shall include:
      (1)   Any weed declared by the Ohio Department of Agriculture, Division of Plant Life, to be a noxious weed as of the effective date of this ordinance.
      (2)   Poison ivy, ragweed, poison oak and poison sumac.
      (3)   In residential, commercial and industrial areas that are eighty percent developed, any vegetation, other than trees, bushes, flowers or other ornamental plants, which exceeds twelve inches in height. In environmentally sensitive areas, natural vegetation is hereby excluded from this classification.
      (4)   Any vegetation which, by reason of the pollen or the seeds which it spreads or produces, or due to the density of its growth or its unsightliness, injuriously affects the public health or welfare.
   (b)   All noxious weeds and rank vegetation, as defined in subsection (a) hereof, are declared to be a nuisance. (Ord. 52-01. Passed 9-25-01.)

706.01 DEFINITIONS.
   As used in this chapter:
   (a)    "Physician" means a person licensed to practice medicine and surgery or osteopathic medicine and surgery pursuant to Ohio R.C. 4731.14 or 4731.29.
   (b)    "Hospital" means a general hospital, or a special hospital devoted to gynecology and obstetrics, which is accredited as a hospital by the Joint Commission on Accreditation of Hospitals of the American College of Physicians, The American College of Surgeons, The American Hospital Association and The American Medical Association, or which is accredited as a hospital by The Accreditation Committee of the Office of Hospital Affairs of the American Osteopathic Association.

706.02 STANDARDS AND PROCEDURES.
   An abortion otherwise permitted by law shall be performed only in a hospital or by a licensed physician in a facility which provides the following standards and procedures which must be met and adhered to:
   (a)    Written verification by two physicians, one of whom may be the physician performing the abortion, of the diagnosis of pregnancy and duration of pregnancy shall be made. Both physicians shall be qualified for diagnosis of such condition and shall verify that they have thoroughly examined the patient at least once prior to the performance of the abortion.
   (b)    There shall be a recorded pre-operative history and physical examination particularly directed to identification of pre-existing or concurrent illnesses or drug sensitivities that may have a bearing on the operative procedures or the anesthesia.
   (c)    Laboratory procedures as are usually required for a hospital admission, including blood type and Rh factor, shall be followed.
   (d)    A receiving facility where the patient may be prepared and receive necessary pre- operative medication and observation prior to the procedure shall be provided.
   (e)    An operating room shall be provided which is properly equipped to safely conduct the abortion procedure and to assure the availability on the premises of adequate blood, oxygen, anesthesia, resuscitation equipment and standby ambulance service to handle complications and emergency situations which could occur during the procedure. Proper anesthesia service shall be administered by a licensed physician.
   (g)    A recovery facility shall be provided which is staffed with at least one Registered Nurse in attendance at all times, in which the patient shall be observed for a twenty-four hour post-operative period. Adequate blood transfusion facilities must be so available that an emergency transfusion can be given in this facility at any time within this twenty-four hour period.
   (h)    The facility shall provide pre-operative and post-operative psychological counseling by an individual appropriately qualified in the field of psychology. Written verification shall be submitted of both the pre-operative and post-operative counseling sessions and shall include the patient's reasons for desiring the abortion and alternatives presented to the patient. Such report shall be kept in the permanent records.
   (i)    Written post-operative instructions shall be given the patient and arrangements shall be made for a post-operative follow-up examination within one month after the abortion. Examination by a certified pathologist of all pathological specimens shall be made. Human remains shall be disposed of in a humanitarian, legal and dignified manner.
   (j)    Adequate permanent records shall be kept and a report shall be made to the Lorain County Health Department of the need for administration of antibiotics, blood transfusion, prolongation of the patient's stay, hospital admission and other complications. The physician performing the abortion must file with the Lorain County Health Department an abortion report form for each abortion, which form shall contain a pathological diagnosis of the estimated age of gestation and the height and weight (in grams) of the fetus. This registry shall be maintained by the Health Department and shall include recording by code numbers, the patients who have been aborted and any complications which resulted.
   (k)    The usual informed consent, including the operative permit signed by the pregnant woman and her parents if she is a legal minor, shall be obtained.
   (l)    The external identification and promotion of such facility shall conform to the provisions of the code of ethics of the national professional organizations of those physicians performing services within the facility.
   (m)    All such facilities shall permit periodic inspection by the Lorain County Health Department.
   (n)    The facility shall meet the standards of the Joint Commission on Accreditation of Hospitals which apply to the areas set forth in this section.

706.03 ABORTION OF VIABLE FETUS.
   No person shall perform or participate in the performance or induction of an abortion of a viable fetus unless such abortion is performed by a physician in a hospital and unless two physicians, one of whom may be the physician performing the abortion, certify in writing that the abortion is necessary to preserve the life or health of the mother.

706.04 INSURANCE.
   An abortion service providing or performing abortions within the City shall furnish a liability policy or copy thereof to the City, with minimum limits of three hundred thousand/ five hundred thousand dollars ($300,000/$500,000), naming the City as an insured and protecting patients of such abortion service against any and all acts of misfeasance or malfeasance by such abortion service or its employees.

706.05 SEPARABILITY.
   The provisions of this chapter are hereby declared to be separable. If any provision, sentence, clause, section or part thereof, is held illegal, invalid, unconstitutional or inapplicable to any person or circumstance, such illegality, invalidity, unconstitutionality or inapplicability shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this chapter or their application to other persons and circumstances.

   (b)    "Hospital" means a general hospital, or a special hospital devoted to gynecology and obstetrics, which is accredited as a hospital by the Joint Commission on Accreditation of Hospitals of the American College of Physicians, The American College of Surgeons, The American Hospital Association and The American Medical Association, or which is accredited as a hospital by The Accreditation Committee of the Office of Hospital Affairs of the American Osteopathic Association.

706.02 STANDARDS AND PROCEDURES.
   An abortion otherwise permitted by law shall be performed only in a hospital or by a licensed physician in a facility which provides the following standards and procedures which must be met and adhered to:
   (a)    Written verification by two physicians, one of whom may be the physician performing the abortion, of the diagnosis of pregnancy and duration of pregnancy shall be made. Both physicians shall be qualified for diagnosis of such condition and shall verify that they have thoroughly examined the patient at least once prior to the performance of the abortion.
   (b)    There shall be a recorded pre-operative history and physical examination particularly directed to identification of pre-existing or concurrent illnesses or drug sensitivities that may have a bearing on the operative procedures or the anesthesia.
   (c)    Laboratory procedures as are usually required for a hospital admission, including blood type and Rh factor, shall be followed.
   (d)    A receiving facility where the patient may be prepared and receive necessary pre- operative medication and observation prior to the procedure shall be provided.
   (e)    An operating room shall be provided which is properly equipped to safely conduct the abortion procedure and to assure the availability on the premises of adequate blood, oxygen, anesthesia, resuscitation equipment and standby ambulance service to handle complications and emergency situations which could occur during the procedure. Proper anesthesia service shall be administered by a licensed physician.
   (g)    A recovery facility shall be provided which is staffed with at least one Registered Nurse in attendance at all times, in which the patient shall be observed for a twenty-four hour post-operative period. Adequate blood transfusion facilities must be so available that an emergency transfusion can be given in this facility at any time within this twenty-four hour period.
   (h)    The facility shall provide pre-operative and post-operative psychological counseling by an individual appropriately qualified in the field of psychology. Written verification shall be submitted of both the pre-operative and post-operative counseling sessions and shall include the patient's reasons for desiring the abortion and alternatives presented to the patient. Such report shall be kept in the permanent records.
   (i)    Written post-operative instructions shall be given the patient and arrangements shall be made for a post-operative follow-up examination within one month after the abortion. Examination by a certified pathologist of all pathological specimens shall be made. Human remains shall be disposed of in a humanitarian, legal and dignified manner.
   (j)    Adequate permanent records shall be kept and a report shall be made to the Lorain County Health Department of the need for administration of antibiotics, blood transfusion, prolongation of the patient's stay, hospital admission and other complications. The physician performing the abortion must file with the Lorain County Health Department an abortion report form for each abortion, which form shall contain a pathological diagnosis of the estimated age of gestation and the height and weight (in grams) of the fetus. This registry shall be maintained by the Health Department and shall include recording by code numbers, the patients who have been aborted and any complications which resulted.
   (k)    The usual informed consent, including the operative permit signed by the pregnant woman and her parents if she is a legal minor, shall be obtained.
   (l)    The external identification and promotion of such facility shall conform to the provisions of the code of ethics of the national professional organizations of those physicians performing services within the facility.
   (m)    All such facilities shall permit periodic inspection by the Lorain County Health Department.
   (n)    The facility shall meet the standards of the Joint Commission on Accreditation of Hospitals which apply to the areas set forth in this section.

706.03 ABORTION OF VIABLE FETUS.
   No person shall perform or participate in the performance or induction of an abortion of a viable fetus unless such abortion is performed by a physician in a hospital and unless two physicians, one of whom may be the physician performing the abortion, certify in writing that the abortion is necessary to preserve the life or health of the mother.

706.04 INSURANCE.
   An abortion service providing or performing abortions within the City shall furnish a liability policy or copy thereof to the City, with minimum limits of three hundred thousand/ five hundred thousand dollars ($300,000/$500,000), naming the City as an insured and protecting patients of such abortion service against any and all acts of misfeasance or malfeasance by such abortion service or its employees.

706.05 SEPARABILITY.
   The provisions of this chapter are hereby declared to be separable. If any provision, sentence, clause, section or part thereof, is held illegal, invalid, unconstitutional or inapplicable to any person or circumstance, such illegality, invalidity, unconstitutionality or inapplicability shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this chapter or their application to other persons and circumstances.

706.99 PENALTY.
   Whoever violates or fails to comply with any of the provisions of this chapter shall be guilty of a misdemeanor of the first degree. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.

706.03 ABORTION OF VIABLE FETUS.
PART SEVEN - BUSINESS REGULATION CODE
706.01 DEFINITIONS.
   As used in this chapter:
   (a)    "Physician" means a person licensed to practice medicine and surgery or osteopathic medicine and surgery pursuant to Ohio R.C. 4731.14 or 4731.29.
   (b)    "Hospital" means a general hospital, or a special hospital devoted to gynecology and obstetrics, which is accredited as a hospital by the Joint Commission on Accreditation of Hospitals of the American College of Physicians, The American College of Surgeons, The American Hospital Association and The American Medical Association, or which is accredited as a hospital by The Accreditation Committee of the Office of Hospital Affairs of the American Osteopathic Association.

   (d)    A receiving facility where the patient may be prepared and receive necessary pre- operative medication and observation prior to the procedure shall be provided.
   (e)    An operating room shall be provided which is properly equipped to safely conduct the abortion procedure and to assure the availability on the premises of adequate blood, oxygen, anesthesia, resuscitation equipment and standby ambulance service to handle complications and emergency situations which could occur during the procedure. Proper anesthesia service shall be administered by a licensed physician.
   (g)    A recovery facility shall be provided which is staffed with at least one Registered Nurse in attendance at all times, in which the patient shall be observed for a twenty-four hour post-operative period. Adequate blood transfusion facilities must be so available that an emergency transfusion can be given in this facility at any time within this twenty-four hour period.
   (h)    The facility shall provide pre-operative and post-operative psychological counseling by an individual appropriately qualified in the field of psychology. Written verification shall be submitted of both the pre-operative and post-operative counseling sessions and shall include the patient's reasons for desiring the abortion and alternatives presented to the patient. Such report shall be kept in the permanent records.
   (i)    Written post-operative instructions shall be given the patient and arrangements shall be made for a post-operative follow-up examination within one month after the abortion. Examination by a certified pathologist of all pathological specimens shall be made. Human remains shall be disposed of in a humanitarian, legal and dignified manner.
   (j)    Adequate permanent records shall be kept and a report shall be made to the Lorain County Health Department of the need for administration of antibiotics, blood transfusion, prolongation of the patient's stay, hospital admission and other complications. The physician performing the abortion must file with the Lorain County Health Department an abortion report form for each abortion, which form shall contain a pathological diagnosis of the estimated age of gestation and the height and weight (in grams) of the fetus. This registry shall be maintained by the Health Department and shall include recording by code numbers, the patients who have been aborted and any complications which resulted.
   (k)    The usual informed consent, including the operative permit signed by the pregnant woman and her parents if she is a legal minor, shall be obtained.
   (l)    The external identification and promotion of such facility shall conform to the provisions of the code of ethics of the national professional organizations of those physicians performing services within the facility.
   (m)    All such facilities shall permit periodic inspection by the Lorain County Health Department.
   (n)    The facility shall meet the standards of the Joint Commission on Accreditation of Hospitals which apply to the areas set forth in this section.

706.03 ABORTION OF VIABLE FETUS.
   No person shall perform or participate in the performance or induction of an abortion of a viable fetus unless such abortion is performed by a physician in a hospital and unless two physicians, one of whom may be the physician performing the abortion, certify in writing that the abortion is necessary to preserve the life or health of the mother.

706.04 INSURANCE.
   An abortion service providing or performing abortions within the City shall furnish a liability policy or copy thereof to the City, with minimum limits of three hundred thousand/ five hundred thousand dollars ($300,000/$500,000), naming the City as an insured and protecting patients of such abortion service against any and all acts of misfeasance or malfeasance by such abortion service or its employees.

706.05 SEPARABILITY.
   The provisions of this chapter are hereby declared to be separable. If any provision, sentence, clause, section or part thereof, is held illegal, invalid, unconstitutional or inapplicable to any person or circumstance, such illegality, invalidity, unconstitutionality or inapplicability shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this chapter or their application to other persons and circumstances.

706.99 PENALTY.
   Whoever violates or fails to comply with any of the provisions of this chapter shall be guilty of a misdemeanor of the first degree. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.

706.99 PENALTY.
PART SEVEN - BUSINESS REGULATION CODE
706.02 STANDARDS AND PROCEDURES.
   An abortion otherwise permitted by law shall be performed only in a hospital or by a licensed physician in a facility which provides the following standards and procedures which must be met and adhered to:
   (a)    Written verification by two physicians, one of whom may be the physician performing the abortion, of the diagnosis of pregnancy and duration of pregnancy shall be made. Both physicians shall be qualified for diagnosis of such condition and shall verify that they have thoroughly examined the patient at least once prior to the performance of the abortion.
   (b)    There shall be a recorded pre-operative history and physical examination particularly directed to identification of pre-existing or concurrent illnesses or drug sensitivities that may have a bearing on the operative procedures or the anesthesia.
   (c)    Laboratory procedures as are usually required for a hospital admission, including blood type and Rh factor, shall be followed.
