1381.01 PERMITTED IN BUSINESS AND INDUSTRIAL DISTRICTS.
   The raising of animals for medical experimentation, the raising of fur bearing animals for commercial purposes, and conducting commercial dog kennels and riding stables or riding academies shall be permitted only in the Business B-3, B-4 and B-5 Districts and Industrial I Districts, as described in the Zoning Code.

1381.02 DEFINITIONS.
   As used in this chapter, certain terms are defined as follows:
   (a)    "Animal" means any live or dead dog (canis familiaris), cat (felix catus), monkey (nonhuman primate mammal), guinea pig, hamster, rabbit or any other warm- blooded animal which is a domesticated pet, or used for exhibition purposes, or is intended for use in research, testing or experimentation. The term excludes livestock and poultry.
   (b)    "Livestock" means horses, ponies, stallions, colts, geldings, mares, sheep, rams, lambs, bulls, bullocks, steers, heifers, cows, calves, mules, jacks, jennets, burros, goats, kids, swine and any animals normally found in the wild state which are being kept for exhibition purposes or as a private pet.
   (c)    "Poultry" means all domesticated fowl and all game birds which are legally held in captivity.
   (d)    "Owner" means any person, firm, association or corporation owning, keeping or harboring any animal, livestock or poultry.
   (e)    "Keeping" or "harboring" an animal, livestock or poultry includes allowing an animal, livestock or poultry to remain, be lodged or fed within a building, enclosure or yard, or maintaining such animal, livestock or poultry in one's custody or control.
   (f)    "Stable" means any structure or building used for the keeping, lodging or feeding of livestock.
   (g)    “Commercial” designation applies where any animals are used for hire, or where fur bearing animals are bred or raised for the sale of pelt or meat, or a permanent sign is erected to indicate the presence of the kennel or stable or academy. (Ord. 103-76. Passed 11-9-76.)
   (h)    "Kennel"means any group of more than four dogs or four cats, more than four months old, kept by an individual, corporation, partnership or other entity at one location within the City. (Ord. 22-05. Passed 1-25-05.)
   (i)    "Hutch" means any cage, structure or building where animals are bred or raised.
   (j)    "Runways" means any area with definite boundaries and in which animals are confined. (Ord. 103-76. Passed 11-9-76.)
1381.03 LOCATION.
   None of the following uses may be located within 100 feet of any dwelling. All buildings, pens and runways, exclusive of pasture, for housing or keeping animals and livestock shall have not less than the following setbacks:

1381.01 PERMITTED IN BUSINESS AND INDUSTRIAL DISTRICTS.
   The raising of animals for medical experimentation, the raising of fur bearing animals for commercial purposes, and conducting commercial dog kennels and riding stables or riding academies shall be permitted only in the Business B-3, B-4 and B-5 Districts and Industrial I Districts, as described in the Zoning Code.

1381.02 DEFINITIONS.

1381.04 MINIMUM LOT SIZE.
   Minimum lot area for the following uses shall be as follows:
   (a)    Riding stable or riding academy; the greater of ten acres or five acres per horse, and a minimum lot width of 500 feet.
   (b)    Commercial fur bearing animal farm; five acres.
   (c)    Raising animals for medical experimentation; five acres.
      (Ord. 103-76. Passed 11-9-76.)
1381.05 FENCE AND SHELTER REQUIREMENTS.
   (a)    No person shall keep any animals for commercial purposes on any lot unless the lot is a fenced area and has a shelter constructed on such lot.
   (b)    A stable, barn or shelter shall be required for the keeping or harboring of livestock. Such stable, barn or shelter shall meet the requirements of the Zoning and Building Codes, shall be kept in a sanitary condition, and shall not be nearer than fifty feet to a street or any property line, or municipal boundary line, nor nearer than 100 feet to any dwelling.

1381.06 OFF STREET PARKING.
   Off street parking is required for each lot subject to this chapter as follows:
   (a)    Boarding kennel or stable; one space for each employee, plus three spaces for each person authorized to admit and release animals.
   (b)    Academy; one space for each employee, plus two spaces for each appointment or student.
   (c)    Veterinary hospitals; one space for each employee plus three spaces for each person authorized to schedule appointments.

   All stables, pens, hutches, yards or other quarters where animals are kept shall be maintained in a sanitary condition. They shall be kept clean and in good repair so as to prevent the breeding of flies and the emission of harmful and offensive odors. Manure piles shall be removed twice each year.

1381.08 ENFORCEMENT.
   The provisions of this chapter shall be administered and enforced by the Building Inspector or by the Dog Warden, who shall have the power to carry out his duties in the enforcement of this chapter.

1381.09 KENNELS.
   No kennel shall withstand any provision of this chapter. No kennel shall be established, kept or maintained in any area of the City which is zoned Residential R-1, R-2 or R-3 or Business B-1 or B-2.

1381.99 PENALTY.
   Whoever violates any provision of this chapter shall be fined not more than fifty dollars ($50.00). Each day during which any violation exists shall constitute a separate violation. (Ord. 103-76. Passed 11-9-76.)

1381.01 PERMITTED IN BUSINESS AND INDUSTRIAL DISTRICTS.
   The raising of animals for medical experimentation, the raising of fur bearing animals for commercial purposes, and conducting commercial dog kennels and riding stables or riding academies shall be permitted only in the Business B-3, B-4 and B-5 Districts and Industrial I Districts, as described in the Zoning Code.

1381.02 DEFINITIONS.
   As used in this chapter, certain terms are defined as follows:
   (a)    "Animal" means any live or dead dog (canis familiaris), cat (felix catus), monkey (nonhuman primate mammal), guinea pig, hamster, rabbit or any other warm- blooded animal which is a domesticated pet, or used for exhibition purposes, or is intended for use in research, testing or experimentation. The term excludes livestock and poultry.
   (b)    "Livestock" means horses, ponies, stallions, colts, geldings, mares, sheep, rams, lambs, bulls, bullocks, steers, heifers, cows, calves, mules, jacks, jennets, burros, goats, kids, swine and any animals normally found in the wild state which are being kept for exhibition purposes or as a private pet.
   (c)    "Poultry" means all domesticated fowl and all game birds which are legally held in captivity.
   (d)    "Owner" means any person, firm, association or corporation owning, keeping or harboring any animal, livestock or poultry.
   (e)    "Keeping" or "harboring" an animal, livestock or poultry includes allowing an animal, livestock or poultry to remain, be lodged or fed within a building, enclosure or yard, or maintaining such animal, livestock or poultry in one's custody or control.
   (f)    "Stable" means any structure or building used for the keeping, lodging or feeding of livestock.
   (g)    “Commercial” designation applies where any animals are used for hire, or where fur bearing animals are bred or raised for the sale of pelt or meat, or a permanent sign is erected to indicate the presence of the kennel or stable or academy. (Ord. 103-76. Passed 11-9-76.)
   (h)    "Kennel"means any group of more than four dogs or four cats, more than four months old, kept by an individual, corporation, partnership or other entity at one location within the City. (Ord. 22-05. Passed 1-25-05.)
   (i)    "Hutch" means any cage, structure or building where animals are bred or raised.
   (j)    "Runways" means any area with definite boundaries and in which animals are confined. (Ord. 103-76. Passed 11-9-76.)
1381.03 LOCATION.
   None of the following uses may be located within 100 feet of any dwelling. All buildings, pens and runways, exclusive of pasture, for housing or keeping animals and livestock shall have not less than the following setbacks:

1381.04 MINIMUM LOT SIZE.
   Minimum lot area for the following uses shall be as follows:
   (a)    Riding stable or riding academy; the greater of ten acres or five acres per horse, and a minimum lot width of 500 feet.
   (b)    Commercial fur bearing animal farm; five acres.
   (c)    Raising animals for medical experimentation; five acres.
      (Ord. 103-76. Passed 11-9-76.)
1381.05 FENCE AND SHELTER REQUIREMENTS.
   (a)    No person shall keep any animals for commercial purposes on any lot unless the lot is a fenced area and has a shelter constructed on such lot.
   (b)    A stable, barn or shelter shall be required for the keeping or harboring of livestock. Such stable, barn or shelter shall meet the requirements of the Zoning and Building Codes, shall be kept in a sanitary condition, and shall not be nearer than fifty feet to a street or any property line, or municipal boundary line, nor nearer than 100 feet to any dwelling.

1381.06 OFF STREET PARKING.
   Off street parking is required for each lot subject to this chapter as follows:
   (a)    Boarding kennel or stable; one space for each employee, plus three spaces for each person authorized to admit and release animals.
   (b)    Academy; one space for each employee, plus two spaces for each appointment or student.
   (c)    Veterinary hospitals; one space for each employee plus three spaces for each person authorized to schedule appointments.

1381.05 FENCE AND SHELTER REQUIREMENTS.
CHAPTER 1381 Stables, Kennels and Animal Shelters
1381.02 DEFINITIONS.
   As used in this chapter, certain terms are defined as follows:
   (a)    "Animal" means any live or dead dog (canis familiaris), cat (felix catus), monkey (nonhuman primate mammal), guinea pig, hamster, rabbit or any other warm- blooded animal which is a domesticated pet, or used for exhibition purposes, or is intended for use in research, testing or experimentation. The term excludes livestock and poultry.
   (b)    "Livestock" means horses, ponies, stallions, colts, geldings, mares, sheep, rams, lambs, bulls, bullocks, steers, heifers, cows, calves, mules, jacks, jennets, burros, goats, kids, swine and any animals normally found in the wild state which are being kept for exhibition purposes or as a private pet.
   (c)    "Poultry" means all domesticated fowl and all game birds which are legally held in captivity.
   (d)    "Owner" means any person, firm, association or corporation owning, keeping or harboring any animal, livestock or poultry.
   (e)    "Keeping" or "harboring" an animal, livestock or poultry includes allowing an animal, livestock or poultry to remain, be lodged or fed within a building, enclosure or yard, or maintaining such animal, livestock or poultry in one's custody or control.
   (f)    "Stable" means any structure or building used for the keeping, lodging or feeding of livestock.
   (g)    “Commercial” designation applies where any animals are used for hire, or where fur bearing animals are bred or raised for the sale of pelt or meat, or a permanent sign is erected to indicate the presence of the kennel or stable or academy. (Ord. 103-76. Passed 11-9-76.)
   (h)    "Kennel"means any group of more than four dogs or four cats, more than four months old, kept by an individual, corporation, partnership or other entity at one location within the City. (Ord. 22-05. Passed 1-25-05.)
   (i)    "Hutch" means any cage, structure or building where animals are bred or raised.
   (j)    "Runways" means any area with definite boundaries and in which animals are confined. (Ord. 103-76. Passed 11-9-76.)
1381.03 LOCATION.
   None of the following uses may be located within 100 feet of any dwelling. All buildings, pens and runways, exclusive of pasture, for housing or keeping animals and livestock shall have not less than the following setbacks:

1381.04 MINIMUM LOT SIZE.
   Minimum lot area for the following uses shall be as follows:
   (a)    Riding stable or riding academy; the greater of ten acres or five acres per horse, and a minimum lot width of 500 feet.
   (b)    Commercial fur bearing animal farm; five acres.
   (c)    Raising animals for medical experimentation; five acres.

1381.05 FENCE AND SHELTER REQUIREMENTS.
   (a)    No person shall keep any animals for commercial purposes on any lot unless the lot is a fenced area and has a shelter constructed on such lot.
   (b)    A stable, barn or shelter shall be required for the keeping or harboring of livestock. Such stable, barn or shelter shall meet the requirements of the Zoning and Building Codes, shall be kept in a sanitary condition, and shall not be nearer than fifty feet to a street or any property line, or municipal boundary line, nor nearer than 100 feet to any dwelling.

1381.06 OFF STREET PARKING.
   Off street parking is required for each lot subject to this chapter as follows:
   (a)    Boarding kennel or stable; one space for each employee, plus three spaces for each person authorized to admit and release animals.
   (b)    Academy; one space for each employee, plus two spaces for each appointment or student.
   (c)    Veterinary hospitals; one space for each employee plus three spaces for each person authorized to schedule appointments.

1381.07 SANITARY REGULATIONS.
   All stables, pens, hutches, yards or other quarters where animals are kept shall be maintained in a sanitary condition. They shall be kept clean and in good repair so as to prevent the breeding of flies and the emission of harmful and offensive odors. Manure piles shall be removed twice each year.

1381.08 ENFORCEMENT.
   The provisions of this chapter shall be administered and enforced by the Building Inspector or by the Dog Warden, who shall have the power to carry out his duties in the enforcement of this chapter.

1381.09 KENNELS.
   No kennel shall withstand any provision of this chapter. No kennel shall be established, kept or maintained in any area of the City which is zoned Residential R-1, R-2 or R-3 or Business B-1 or B-2.

1381.99 PENALTY.
   Whoever violates any provision of this chapter shall be fined not more than fifty dollars ($50.00). Each day during which any violation exists shall constitute a separate violation. (Ord. 103-76. Passed 11-9-76.)

1381.99 PENALTY.
CHAPTER 1381 Stables, Kennels and Animal Shelters
1381.02 DEFINITIONS.
   As used in this chapter, certain terms are defined as follows:
   (a)    "Animal" means any live or dead dog (canis familiaris), cat (felix catus), monkey (nonhuman primate mammal), guinea pig, hamster, rabbit or any other warm- blooded animal which is a domesticated pet, or used for exhibition purposes, or is intended for use in research, testing or experimentation. The term excludes livestock and poultry.
   (b)    "Livestock" means horses, ponies, stallions, colts, geldings, mares, sheep, rams, lambs, bulls, bullocks, steers, heifers, cows, calves, mules, jacks, jennets, burros, goats, kids, swine and any animals normally found in the wild state which are being kept for exhibition purposes or as a private pet.
   (c)    "Poultry" means all domesticated fowl and all game birds which are legally held in captivity.
   (d)    "Owner" means any person, firm, association or corporation owning, keeping or harboring any animal, livestock or poultry.
   (e)    "Keeping" or "harboring" an animal, livestock or poultry includes allowing an animal, livestock or poultry to remain, be lodged or fed within a building, enclosure or yard, or maintaining such animal, livestock or poultry in one's custody or control.
   (f)    "Stable" means any structure or building used for the keeping, lodging or feeding of livestock.
   (g)    “Commercial” designation applies where any animals are used for hire, or where fur bearing animals are bred or raised for the sale of pelt or meat, or a permanent sign is erected to indicate the presence of the kennel or stable or academy. (Ord. 103-76. Passed 11-9-76.)
   (h)    "Kennel"means any group of more than four dogs or four cats, more than four months old, kept by an individual, corporation, partnership or other entity at one location within the City. (Ord. 22-05. Passed 1-25-05.)
   (i)    "Hutch" means any cage, structure or building where animals are bred or raised.
   (j)    "Runways" means any area with definite boundaries and in which animals are confined. (Ord. 103-76. Passed 11-9-76.)
1381.03 LOCATION.
   None of the following uses may be located within 100 feet of any dwelling. All buildings, pens and runways, exclusive of pasture, for housing or keeping animals and livestock shall have not less than the following setbacks:

1381.04 MINIMUM LOT SIZE.
   Minimum lot area for the following uses shall be as follows:
   (a)    Riding stable or riding academy; the greater of ten acres or five acres per horse, and a minimum lot width of 500 feet.
   (b)    Commercial fur bearing animal farm; five acres.
   (c)    Raising animals for medical experimentation; five acres.
      (Ord. 103-76. Passed 11-9-76.)
1381.05 FENCE AND SHELTER REQUIREMENTS.
   (a)    No person shall keep any animals for commercial purposes on any lot unless the lot is a fenced area and has a shelter constructed on such lot.
   (b)    A stable, barn or shelter shall be required for the keeping or harboring of livestock. Such stable, barn or shelter shall meet the requirements of the Zoning and Building Codes, shall be kept in a sanitary condition, and shall not be nearer than fifty feet to a street or any property line, or municipal boundary line, nor nearer than 100 feet to any dwelling.

1381.06 OFF STREET PARKING.
   Off street parking is required for each lot subject to this chapter as follows:
   (a)    Boarding kennel or stable; one space for each employee, plus three spaces for each person authorized to admit and release animals.
   (b)    Academy; one space for each employee, plus two spaces for each appointment or student.
   (c)    Veterinary hospitals; one space for each employee plus three spaces for each person authorized to schedule appointments.

1381.07 SANITARY REGULATIONS.
   All stables, pens, hutches, yards or other quarters where animals are kept shall be maintained in a sanitary condition. They shall be kept clean and in good repair so as to prevent the breeding of flies and the emission of harmful and offensive odors. Manure piles shall be removed twice each year.

1381.08 ENFORCEMENT.
   The provisions of this chapter shall be administered and enforced by the Building Inspector or by the Dog Warden, who shall have the power to carry out his duties in the enforcement of this chapter.

1381.09 KENNELS.
   No kennel shall withstand any provision of this chapter. No kennel shall be established, kept or maintained in any area of the City which is zoned Residential R-1, R-2 or R-3 or Business B-1 or B-2.

1381.99 PENALTY.
   Whoever violates any provision of this chapter shall be fined not more than fifty dollars ($50.00). Each day during which any violation exists shall constitute a separate violation. (Ord. 103-76. Passed 11-9-76.)
