  REGULATIONS
 
373.01 APPLICATION OF REGULATIONS.
   These regulations applicable to bicycles and/or tricycles shall apply whenever a bicycle and/or tricycle is operated upon any sidewalk or street or upon any path set aside for the exclusive use of bicycles and/or tricycles, subject to those exceptions stated herein. All bicycles and tricycles shall be licensed by the City as provided in this chapter. (Ord. 45-88. Passed 6-14-88.)
373.02 DEFINITIONS.
   As used in this chapter:
   (a)    "Bicycle." See Section 301.04 (a) of this Code.
   (b)    "Tricycle" means a three wheel adult vehicle propelled by human power, having a single front wheel and two parallel rear wheels measuring over twenty inches in diameter. (Ord. 45-88. Passed 6-14-88.)
373.03 PARENT'S RESPONSIBILITY.
   The parent of any child and the guardian of any ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this chapter.

373.04 TRAFFIC CODE APPLICATION.
   Every person riding a bicycle or tricycle upon a street shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of the State, or by the traffic ordinances of the City applicable to the driver of a vehicle, except as to special regulations in this chapter which, by their nature, can have no application.

373.05 OBEDIENCE TO TRAFFIC CONTROL DEVICES.
   (a)    Any person operating a bicycle or tricycle shall obey the instructions of official traffic control signals, signs and other control devices applicable to vehicles unless otherwise directed by a police officer.
   (b)    Whenever authorized signs are erected that no right, left or "U" turns are permitted, no person operating a bicycle or tricycle shall disobey the direction of any such sign, except where such person dismounts from the bicycle or tricycle to make any such turn, in which event such person shall then obey the regulations applicable to pedestrians.

373.06 RIDING ON STREETS.
   It shall be legal to ride a bicycle or tricycle upon a street or public way, subject to the following:
   (a)    Every person operating a bicycle or tricycle upon a roadway shall ride within three feet of the right edge of the roadway when practicable, obeying all traffic rules applicable to vehicles and exercising due care when passing a standing vehicle or one proceeding in the same direction.
   (b)    Persons riding bicycles or tricycles upon a roadway shall ride single file in a single lane, except on paths or parts of roadways set aside for the exclusive use of bicycles or tricycles.
   (c)    Wherever a designated path for bicycles and tricycles has been provided adjacent to a street, bicycle and tricycle riders shall use such path and shall not use the street. At no time shall a bicyclist or bicyclist under the age of seven operate a bicycle or tricycle on a street.
   (d)    No person shall ride a bicycle or tricycle on the pavement or berm of major streets that are posted as prohibiting bicycle riding. Those posted streets shall be designated by the Director of Public Safety.
   (e)    Whenever a person is riding a bicycle or tricycle upon a street, such person shall yield the right of way to any pedestrian.
   (f)    When a bicycle or tricycle is operated on the street, the operator shall give hand signals before turning, changing lanes or stopping. Such signals shall conform with the Motor Vehicle Laws of the State.
   (g)    No person shall operate a bicycle or tricycle at a speed greater than is reasonable and proper under the conditions then existing nor in excess of any posted speed limit established within the City.
   (h)    No person riding upon any bicycle, tricycle, motorcycle, coaster, roller skates, sled or toy vehicle shall attach the same or himself to any vehicle upon a street.
   (i)    No operator shall knowingly permit any person riding upon any bicycle, tricycle, coaster, roller skates, sled or toy vehicle to attach the same or himself to any vehicle while moving upon a roadway, provided, however, that it shall be lawful to tow any disabled vehicle.
   (j)    No person shall park a bicycle or tricycle upon a roadway in such a manner as to interfere with vehicular traffic.

373.07 RIDING ON BICYCLE PATHS OR SIDEWALKS.
   It shall be legal to ride a bicycle or tricycle upon a sidewalk, or public way, or upon any path set aside for the exclusive use of bicycles and/or tricycles, subject to the following:
   (a)    Wherever a designated path for bicycles and tricycles has been provided adjacent to a street, bicycle and tricycle riders shall use such path and shall not use the street.
   (b)    Any person operating a bicycle or tricycle may ride upon the sidewalk rather than the roadway when sidewalks are available and not congested with pedestrian traffic. If the sidewalk is congested with pedestrian traffic, the bicycle or tricycle operator using the sidewalk shall walk the bicycle or tricycle. At no time shall a bicyclist or tricycle under the age of seven operate a bicycle or tricycle on a street.
   (c)    No person shall ride a bicycle or tricycle upon a sidewalk upon or along which signs have been erected by authority of the Director of Public Safety prohibiting such bicycle riding.
   (d)    Whenever a person is riding a bicycle or tricycle upon a sidewalk such person shall yield right of way to any pedestrian and shall give an audible signal before attempting to overtake and pass a pedestrian or another bicycle or tricycle. This audible signal must be given only by a bell or other warning device capable of giving an audible signal, but in no event shall a siren or whistle be used for signaling purposes. Such signal shall be given at a distance and in such a manner as not to startle a person being overtaken and passed.
   (e)    No person shall ride a bicycle or tricycle across or through an intersection when approaching an intersection on a sidewalk. Such intersections are to be crossed by walking the bicycle or tricycle across or through the intersection.
   (f)    Whenever a person is riding a bicycle or tricycle upon a sidewalk, the person before overtaking and passing a blind person carrying a white cane, shall dismount and overtake or pass on foot.
   (g)    No person shall park a bicycle or tricycle upon a sidewalk in such a manner so as to interfere with pedestrian traffic or endanger the property of another.

373.08 RIDING ON PROPER SEAT; TRICK RIDING.
   (a)    A person operating a bicycle or tricycle shall not ride other than astride a permanent and regular seat attached thereto, or carry any other person upon such bicycle or tricycle other than upon a firmly attached and regular seat thereon, nor shall any person ride upon a bicycle or tricycle other than upon such a firmly attached and regular seat.
   (b)    No bicycle or tricycle shall be used to carry more persons at one time than the number for which it is designed and equipped.
   (c)    No person shall engage in trick riding or operate a bicycle or tricycle without both hands upon the handle grips, except when necessary to give the hand signals required herein. (Ord. 45-88. Passed 6-14-88.)
373.09 EMERGING FROM ALLEY OR DRIVEWAY.
   (a)    The operator of a bicycle or tricycle emerging from an alley, driveway or building shall, upon approaching a sidewalk or the sidewalk area extending across any alley or driveway, yield the right of way to all pedestrians approaching on such sidewalk area and upon entering the street shall yield the right of way to all vehicles approaching on such street.
   (b)    Every rider of a bicycle or tricycle shall exercise due care to avoid colliding with any pedestrian or any vehicle upon any roadway, sidewalk or bicycle path, or endangering the life, limb or property of any person while in the lawful use of the streets, sidewalks or any other private or public property.

373.10 CARRYING ARTICLES.
   No person operating a bicycle shall carry any package, bundle or article that prevents the driver from keeping at least one hand upon the handlebars.

373.11 STOLEN BICYCLES AND/OR TRICYCLES.
   No person shall steal any bicycle or tricycle or purposely take, ride or operate any bicycle or tricycle without consent of the owner thereof, or buy or conceal any bicycle or tricycle that has been stolen, knowing it to have been stolen.

373.12 LAMPS AND OTHER EQUIPMENT.
   (a)    Every bicycle and tricycle when in use in the night season, shall be equipped with the following:
       (1)    A lamp on the front that shall emit a white light visible from a distance of at least 500 feet to the front;
      (2)    A red reflector on the rear of a type approved by the Ohio Director of Highway Safety that shall be visible from all distances from 100 feet to 600 feet to the rear when directly in front of lawful lower beams of head lamps on a motor vehicle;
      (3)    A lamp emitting a red light visible from a distance of 500 feet to the rear shall be used in addition to the red reflector;
      (4)    An essentially colorless reflector on the front of a type approved by the Director;
      (5)    Either with tires with retroreflective sidewalls or with an essentially colorless or amber reflector mounted on the spokes of the front wheel and an essentially colorless or red reflector mounted on the spokes of the rear wheel. Each reflector shall be visible on each side of the wheel from a distance of 600 feet when directly in front of lawful lower beams of head lamps on a motor vehicle. Retroreflective tires or reflectors shall be of a type approved by the Director. (A.O.)
    (b)    No person shall operate a bicycle or tricycle unless it is equipped with a bell or other warning device capable of giving a signal audible for a distance of at least 100 feet, except that a bicycle or tricycle shall not be equipped with nor shall any person use on a bicycle or tricycle any siren or whistle.
   (c)    Every bicycle and tricycle shall be equipped with a brake which will enable the operator to make the brake wheel skid on dry, level pavement and in addition, such brakes shall conform to the provisions of Chapter 337 of this Traffic Code.
