Ch. 4749 Private police officer training programs - see OAC Ch. 109:2-3     761.01 DEFINITIONS.    The terms "private investigator", "business of private investigation", "security guard provider" and "business of security services", as used in this chapter shall be defined as provided in Ohio R.C. 4749.01 provided, however, that the terms "private investigator", "business of private investigation", "security guard provider" and "business of security services" shall not include or apply to a person regularly employed as a full or hourly police officer or police patrolman of the City or of any other municipality or county within the State. Passed 5-23-89.) 761.02 REGISTRATION REQUIRED.    No individual, corporation or partnership shall operate as a private investigator or security guard provider or shall engage in the business of private investigation or the business of security services within the City until such individual, corporation or partnership has registered with the Police Department and upon registration has provided the following:    (a)   The name, current address and social security number or Federal Identification numbers of the individual, partnership or corporation holding the Class A, B, or C license issued by the State of Ohio Department of Public Safety pursuant to Ohio R.C. 4749.03 under which such individual, partnership or corporation is operating. A copy of such license shall be supplied to the Police Department upon registration, and    (b)   The names, current address and social security number of all employees engaged in the business of private investigation, the business of security services, or both and a copy of the identification card with picture, furnished by the State of Ohio Department of Public Safety to such an employee shall be supplied to the Police Department upon registration.    (c)   Prior to the issuance of a permit to a private investigator, business of private investigation, security guard provider or business of security services an annual permit fee of one hundred dollars ($100.00) shall be paid to the City. Such shall be paid annually and if not paid annually the permit shall not be renewable.       (Ord. 88-07. Passed 12-27-07.) 761.03 FIREARMS BEARER.    (a)   No person to whom a Class A, B or C license is issued pursuant to Ohio R.C. 4749.03, and no registered employee of such license holder shall carry a firearm in the course of engaging in the business of private investigation, the business of security services, or both, unless he has a notation on his identification card issued by the State of Ohio Department of Public Safety that he is a firearm bearer and until he is registered with the Police Department, as provided in Section 761.02 and has supplied a copy of his identification card bearing such notation.    (b)    The firearms bearer and/or his employer will provide a certified copy of the bearer records establishing that he has qualified with the particular firearm that he will carry while working in the City. If he changes firearms he must submit a certified copy of his qualification with such replacement firearm prior to employment as a firearm bearer in the City.    (c)    The firearms bearer may not bear or carry any firearm with a caliber larger than 9 mm.    (d)    The firearms bearer, prior to employment in the City will register his firearm with the Police Department.    (e)    The firearm bearer must provide to the Sheffield Lake Police Department annual certified copies of his ongoing qualification with the firearm carried during his period of employment in the City.    (f)    The firearms instructor certifying the firearms bearer must be certified by the State of Ohio as a firearms instructor and must have a current instructor's permit. (Ord. 87-07. Passed 12-27-07.) 761.99 PENALTY.    Whoever violates this chapter shall be guilty of a misdemeanor of the third degree, each day on which any such violation occurs shall constitute a separate offense.
