OFF. 521.08     961.01 APPLICATION OF CHAPTER.    The use of parks and parkways and other lands controlled by the Director of Public Service and/or Park-Recreation Board shal1 be under and subject to the provisions of this chapter. (Ord. 56-22. Passed 10-11-22.) 961.02 DEFINITIONS.    The following terms as used in this chapter shall have the meanings ascribed to them herein:    (a)   "Park" means any and all land controlled by the Director of Public Service and/or Park-Recreation Board.    (b)   "Board" means the Park-Recreation Board, or its designated representative.    (c)   "Director" means the Director of Public Service.    (d)   "Person" includes individuals and corporations.       (Ord. 56-22. Passed 10-11-22.)   961.03 INJURY OR DESTRUCTION OF PROPERTY, VEGETATION, ETC.    (a)   No person shall injure, deface, destroy, disturb or remove any part of a park or building, sign, equipment or other property found therein, nor shall any tree, flower, shrub or other vegetation or fruit or seed thereof, or rock or mineral be removed, injured, destroyed or disturbed.    (b)   Any person who violates provisions of subsection (a) of this section shall be guilty of a first degree misdemeanor and shall be required, in addition to any other penalty, to make restitution for any such injury, defacement, destroying, disturbing or removing caused by them. Passed 10-11-22.) 961.04 LITTERING; NOXIOUS MATERIALS.    No person, without the specific written consent of the Director of Public Service, shall bring into, leave behind or dump any material of any kind in a park except the refuse, ashes, garbage and other material of a picnic, camp or other permitted activity, provided that such material is deposited in receptacles or pits provided for such purposes.    No person shall either within or outside of a park, discharge into any pipe, drain, sewer, ditch or natural tributary watercourse that flows, through or onto park lands, any liquid or aqueous waste or any noxious or deleterious material which may render park waters harmful or inimical to the public health or to animal, vegetation or aquatic life, or which may prevent, limit or interfere with the use of such waters for domestic purposes, or which may lessen to an unreasonable degree the use and enjoyment of such water for park lands or for recreational or other park uses. Passed 10-11-22.) 961.05 FIREARMS, FIREWORKS AND EXPLOSIVES.    No person, except a police officer or other law enforcement officer, shall carry an air or gas gun, sling shot, or missile throwing device within a park, or discharge any fireworks, explosive substance or air or gas gun. A lawful firearm may only be discharged in an act of self-defense in the face of deadly force. (Ord. 56-22. Passed 10-11-22.) 961.06 INDECENT CONDUCT AND EXPOSURE.    No person shall appear in a park in a state of nudity, or commit, perform or engage in any lewd, lascivious, obscene or indecent act or behavior and no person shall make any indecent exposure of his or her person.
