1377.01 REQUIRED IF BY STATE LAW OR IN NEW RESIDENTIAL CONSTRUCTION.
   (a)   Smoke detectors shall be installed in any building in the City where the installation of smoke detectors is required by Ohio laws.
   (b)    Smoke detectors shall be installed in any new residential construction in the City. (Ord. 45-79. Passed 5-8-79.)
1377.02 INSTALLATION PRIOR TO OCCUPANCY OR OCCUPANCY PERMIT ISSUANCE.
   (a)    All residential rental dwelling units, single-family and all multi-family dwellings which are rented, leased or otherwise let shall not be occupied nor shall any occupancy permit be issued for any such dwelling unit unless a smoke detector is installed in such dwelling unit.
   (b)    No re-occupancy permit shall be issued by the City or its Building Inspector for any residential dwelling unit unless a smoke detector has been installed in such residential dwelling unit in accordance with this chapter.

1377.03 OCCUPANCY PERMIT DENIAL FOR NONCOMPLIANCE.
   Failure to comply with any provision of this chapter shall be just cause for the Building Inspector to refuse to issue an occupancy permit for any building or new construction which is required by this chapter to have a smoke detector and which does not.

1377.99 PENALTY.
   Whoever violates any provision of this chapter is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00). A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
