724.01 LICENSE REQUIRED.
   (a)    A special peddler's license shall be required of all persons who wish to engage in the sale of various ice creams, custards, frozen sherbets or other frozen desserts during the summer months from push carts, wagons or other vehicles.
   (b)    Such license shall be issued to no person under the age of eighteen years and a condition precedent to the issuance of such a license shall be a duly authenticated birth certificate. The applicant shall also obtain at his own expense, a certificate of health from a physician. (Ord. 74-58. Passed 10-28-58.)
724.02 APPLICATION; INVESTIGATION.
   An application shall be secured from the Mayor and after the requirements of Section 724.01 have been complied with, the application shall be submitted to the Division of Police which shall investigate and determine that the applicant has no known police record, as far as the Division can ascertain.

724.03 PHOTOGRAPH FOR LICENSE.
   After certification by the Division of Police, the applicant shall return the application to the Mayor together with a photograph of himself, which photograph shall be affixed to the license by the Mayor.
   The license shall contain a description of the peddler, showing his height, age, weight, color of eyes, color of hair and any other pertinent physical aspects which the Mayor deems necessary.

724.04 LICENSE EXPIRATION; TRANSFER; FEE.
   A special peddler's license shall not be transferable to any other person, and the license shall expire on the last day of each calendar year.
   The license fee shall be forty dollars ($40.00) per year.

724.05 PLACE OF SALES.
   No sales of merchandise shall be made to children within the area of the public streets or roadways. Sales may be made only within the tree lawn or sidewalk area.

724.99 PENALTY.
   Whoever violates any of the provisions of this chapter shall be guilty of a misdemeanor of the second degree. Each day's continued violation shall constitute a separate offense.
