748.06 PRIZES OR AWARDS PROHIBITED.
CHAPTER 748 Mechanical Amusement Devices
748.01 DEFINITIONS.
As used in this chapter, unless the context otherwise indicates:
(a) "Mechanical amusement device" means a machine which, upon the insertion of a coin or slug, operates or may be operated for use as a game, contest or amusement of any description, which may be used for any such game, contest or amusement and which contains no automatic payoff device for the return of money, coins, merchandise, tokens or checks redeemable in money or anything of value.
(b) "Person","firm", "corporation" or "association", means any person, firm, corporation or association which owns any such machine; the person, firm, corporation or association in whose place of business any such machine is placed for use by the public; and the person, firm, corporation or association having control over such machine.

748.02 LICENSE REQUIRED.
No person shall display or exhibit a mechanical amusement device or devices without having first obtained a license for each of such mechanical amusement devices from the City. A separate license shall be required for each mechanical amusement device displayed at any one time.

748.03 APPLICATION FOR LICENSE.
(a) Application for a license to display one, two or three mechanical amusement devices must be made to the Building Inspector of the City upon forms prepared by the City. Such application must be made by the owner or proprietor of the business or place at which such mechanical amusement device is to be displayed. Application for a license to display more than three mechanical amusement devices at any one location must be made to the Mayor upon forms prepared by the City. Such application must be made by the owner or proprietor of the business or place at which such mechanical amusement devices are to be displayed.
(b) The application shall state the name of the owner of such place of business, the address of the place for which the license is applied, the resident address of the owner, the serial number and name of the manufacturer of the mechanical amusement device or devices, the owner of such device or devices, the name and address of the distributor or vendor of such mechanical amusement device or devices, the nature of the business in conjunction with which such mechanical amusement device or devices are to be displayed and such other and further information as may be required by the City.

748.04 ISSUANCE OF LICENSE; FEE.
(a) Upon the approval of an application and upon the payment of the annual license fee of twenty-five dollars ($25.00), per mechanical amusement device, a license to display such mechanical amusement device or devices shall be issued to the applicant. Such license fee shall be for the fiscal year beginning June 1 of the calendar year or for any unexpired portion of any such fiscal year. Such license fee shall entitle licensee therein named to display at or upon the premises therein described the mechanical amusement devices for which licenses have been obtained. The license for the mechanical amusement devices shall be posted in a prominent place readily visible by any patrons, customers or other individuals entering into the premises which the mechanical amusement device or devices are displayed
(b) Nothing in this section shall be intended to prohibit any person or the owner of a place of business from purchasing a mechanical amusement device or devices outright from any source, provided a license is obtained as hereinbefore set forth and provided further that a bill of sale therefor is presented.

748.05 TRANSFER; LOCATION.
(a) A separate license shall be required for each and every mechanical amusement device which is displayed by any person at any one time but any licensee may change from the display of one approved mechanical amusement device to the display of another approved mechanical amusement device at any time. A license issued under the provisions of this chapter shall not be transferred from one person to another person, but such license may be transferred by the licensee therein named from the place specified in such license to another place owned by such licensee should the licensee move his business from the address specified in the license to another location.
(b) No license shall be issued for the display of a mechanical amusement device at a place which is within 1000 feet from any premises occupied by any school building or church building. It shall be the duty of the licensee to conspicuously display the license issued hereunder. (Ord. 16-64. Passed 3-10-64.)
748.06 PRIZES OR AWARDS PROHIBITED.
No person by himself, by another person or otherwise, directly or indirectly, shall give any prize, award, merchandise, gift or anything of value to any player or any operator of any mechanical amusement device, or to any contestant, for a high score on any such device.

748.07 NEW OR MODIFIED MACHINES.
Any new type or modification of a mechanical amusement device not presently licensed or operating in the City shall first be presented by the person for inspection to the Chief of Police and the Director of Law, who thereafter shall submit their recommendations to the members of Council for their consideration and approval for the licensing of such new or modified mechanical amusement device pursuant to this chapter.

748.99 PENALTY.
(a) Whoever violates any of the provisions of this chapter shall be guilty of a minor misdemeanor. Each day such violation continues shall constitute a separate and distinct offense.
(b) In addition, the Mayor is authorized to revoke the license held by any person who has been convicted of a violation of any of the provisions of this chapter.
