1521.01 Barricades; warning lights; protective devices.

1521.01 BARRICADES; WARNING LIGHTS; PROTECTIVE DEVICES.
(a) Any individual, corporation or entity that is the owner of a building or structure, whether residential, commercial or otherwise, within the City of Sheffield Lake, that is damaged by fire or other cause to such an extent that in the opinion of the Fire Chief or the Fire Chief’s designee or the Service Director, or the Service Director’s designee; the damaged building or structure or the premises on which the damaged building or structure is located, is determined to be a real and significant danger to the general public and/or the residents of the City and/or the City of Sheffield Lake, shall cause there to be established and placed around the damaged building and/or structure and/or premises on which said building or structure is located, sufficient barricades and/or warning lights and/or other protective devices and shall cause said building or structure to be boarded and enclosed all in a manner and of a type and kind satisfactory to the Fire Chief or the Fire Chief’s designee or the Service Director or the Service Director’s designee as to warn the general public and the residents of the City of the danger and to keep the residents of the City and the general public reasonably away from and out of the damaged building or structure and off of the premises on which the damaged building or structure is located until such time as the damaged building or structure is repaired or otherwise placed in a condition that the damaged building or structure and the premises on which said damaged building or structure is located is no longer a danger to the general public and the residents of the City and the City of Sheffield Lake, Ohio.
(b) The individual, corporation or entity owning such damaged building or structure shall cause the barricades and/or warning lights and/or other protective devices to be placed around the damaged building or structure and premises immediately upon receiving notification of the dangerous condition. The individual, corporation or other entity owning such damaged building or structure shall be deemed to have received such notification upon the placing of such notification on the damaged building or structure or premises on which such damaged building or structure is located by the Fire Chief or Service Director. Such notice shall be deemed placed on the damaged building or structure or premises on which the damaged building or structure is located by such notice being placed there in writing on a form of a type and kind to be determined to be appropriate by the Fire Chief and/or Service Director. Such notice shall be signed by the Fire Chief and/or Service Director or the designee of either and shall be dated. (Ord. 47-97. Passed 7-8-97.)
1521.02 FAILURE TO COMPLY.
In addition to all other provisions of and penalties provided for in this chapter should the owner of any building or structure as set forth in this chapter fail, upon receiving notification of the dangerous condition of a building or structure as set forth herein, to immediately cause there to be established and placed around the damaged building and/or structure and/or premises on which said building or structure is located, sufficient barricades and/or warning lights and/or other protective devices and fail to cause said building or structure to be boarded and enclosed in a manner and of a type and kind satisfactory to the Fire Chief or Service Director, the City, may at its option cause such building or structure to be made secure and/or boarded up and enclosed with the cost of such securing and/or boarding up to be assessed against the property on which the vacant structure or building is located and to be paid by the owner. In addition to any other remedies available to the City, the City may cause the cost of such securing and/or boarding up to be turned over to the Treasurer of Lorain County, Ohio, and the Auditor of Lorain County, Ohio, for certification and assessment as a lien against the real estate and shall cause the cost to be certified on the tax duplicate against the real estate. 1521.99 PENALTY.
Any individual, corporation or other entity violating any provision of this chapter shall be guilty of a misdemeanor of the first degree.
