561.01 Removal of weeds by owner or occupant; notice.
561.02 Cutting of grass and weeds by Municipality.

561.01 REMOVAL OF WEEDS BY OWNER OR OCCUPANT; NOTICE.
(a) The owner, occupant or person having charge of management of any lot or parcel of land situated within the City, whether the same is improved or unimproved, vacant or occupied, within five days written notice, served upon him in conformity with Ohio R.C. 731.52, shall cut or destroy or cause to be cut or destroyed any weeds, vines or grasses growing upon any such lot or parcel of land and prevent the same from blooming or going to seed or exceeding a height of six inches.
(b) Whoever violates or fails to comply with this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. (Ord. 20-82. Passed 3-9-82.)
561.02 CUTTING OF GRASS AND WEEDS BY MUNICIPALITY.
In the event the property owner does not cut or destroy his grass, weeds or vines, in accordance with Section 561.01, then the Service Director is authorized to cause such grass to be cut and such weeds or vines cut or destroyed. The City shall charge the property owner a fee to cut said grass, weeds or vines, not less than one hundred dollars ($100.00) nor more than two hundred fifty dollars ($250.00), said amount to be determined by the Service Director and to be based on the size of the yard and the amount of time required to perform the work. Said charge shall be billed to the property owner of record or person responsible for said property and certified to the Lorain County Treasurer to be assessed on the property owner’s real estate tax bill.

561.03 ABATEMENT OF NUISANCE BY MUNICIPALITY.
(a) Should the Building Inspector or his designee, after the inspection of any lot or parcel of land situated within the City, whether the same is improved or unimproved, vacant or occupied, determine that the lot or parcel of land has upon it weeds, vines, grasses or other growing substances of any type or kind whatsoever or any standing water, litter, rubbish, refuse or other substance of any type or kind whatsoever that is or are not properly upon such lot or parcel of land; or that such lot or parcel of land in any way constitutes a nuisance within the City: The Building Inspector or his designee shall notify the owner, occupant or person having charge or management of the lot or parcel of land of any such condition or nuisance and that such condition or nuisance must be abated; and that such condition of the lot or parcel of land, is found to be in violation of the ordinances or resolutions of the City or of a statute of the State of Ohio; or to constitute a nuisance.
(b) Should the owner, occupant or person having charge or management of the lot or parcel of land fail to cause such condition to be remedied or nuisance to be abated within five days of the written notice, the Building Inspector or his designee shall notify the Service Director of such failure.
(c) Upon notification of such failure, Service Director shall have the authority to declare that provisions of this section be enforced and shall have the authority to cause the condition or nuisance to be remedied or abated in accordance with Section 561.02.

561.04 NOXIOUS WEEDS AND RANK VEGETATION DEFINED; DECLARATION OF A NUISANCE.
(a) Noxious weeds and rank vegetation shall include:
(1) Any weed declared by the Ohio Department of Agriculture, Division of Plant Life, to be a noxious weed as of the effective date of this ordinance.
(2) Poison ivy, ragweed, poison oak and poison sumac.
(3) In residential, commercial and industrial areas that are eighty percent developed, any vegetation, other than trees, bushes, flowers or other ornamental plants, which exceeds twelve inches in height. In environmentally sensitive areas, natural vegetation is hereby excluded from this classification.
(4) Any vegetation which, by reason of the pollen or the seeds which it spreads or produces, or due to the density of its growth or its unsightliness, injuriously affects the public health or welfare.
(b) All noxious weeds and rank vegetation, as defined in subsection (a) hereof, are declared to be a nuisance. (Ord. 52-01. Passed 9-25-01.)
