965.01 DEFINITIONS.
   For the purpose of this chapter the following terms shall be defined as follows:
   (a)   "Garbage" means all putrescible waste except sewage and body waste, including refuse from the preparation of foods or surplus foodstuffs.
   (b)   "Rubbish" means glass, crockery, grass, shrubbery, clippings, ashes from incinerators, cans and other food containers, paper, boxes, rags, clothing, small metal parts weighing less than five pounds each and wood in pieces small enough to fit into garbage cans. Rubbish does not mean earth, ashes from furnaces or other general heating plants, brick, stone, plaster, brush, substances accumulated as the result of any new or old construction operations or the dismantling or razing of any structure or the remodeling of any house or building.
   (c)    "City" means the City of Sheffield Lake, Ohio.
   (d)    "Director" means the Director of Public Service.
   (e)   "Resident" means the head of a household or family of one maintaining his or her separate living room or quarters on the premises and shall include owners, tenants and occupants of all premises upon which garbage or rubbish or both is accumulated.
   (f)   "Premises" means land or buildings or both, or parts of either or both, occupied by a resident.
   (g)   "Person" means every natural person, association of persons, partnership or corporation.
   (h)    "Collector" means the City or its authorized agent.

965.02 TYPE OF CONTAINERS; ACCESSIBILITY.
   (a)   It shall be the duty of each resident in or upon premises within the City where garbage or rubbish is allowed to accumulate to comply with the terms and conditions of the Contract as amended between the City of Sheffield Lake and the current Collecting Agent, presently Allied Waste, dba Browning-Ferris Industries and such further Rules and Regulations as may from time to time be agreed upon so as to implement an automated cart program for refuse collection and recycling throughout the City. All Containers shall be placed on ground level of the premises within five feet of the roadway passing and traversing in front of the premises so as to be easily accessible to and for collection on the day or days designated by the Director of Public Service as collection days for the premises.
   (b)    No individual corporation or other entity shall cause any container described in subsection (a) hereof to be placed to be accessible to and for collection on the days designated by the Director of Public Services as collection days for the premises at any times save and except as follows: From 7:00 a.m. of the morning before the day designated for collection on said premises until 6:00 p.m. on the day designated for collection for said premises.

   (c)   No individual corporation or other entity shall cause any rubbish as defined in subsection 965.01(b), or any other bulk items to be placed for collection on the days designated by the Director of Public Services as collection days for the premises at any times save and except as follows: from 6:00 p.m. of the night before the day designated for collection on said premises until 6:00 p.m. on the day designated for collection for said premises. 965.03 FEE.
   (a)    The monthly rate per residential customer for rubbish and refuse collection within the City shall be fourteen dollars and seventy-two cents ($14.72) per month per residential customer with bills for rubbish and refuse collection rendered on and after February 1, 2005.
   (b)    The monthly rate per residential customer for rubbish and refuse collection within the City shall be redetermined and recalculated annually for each year subsequent to 2005.
   (c)    When annually recalculating the monthly rate per residential customer for rubbish and refuse collection within the City, the City shall apply a percentage increase to the monthly rate per residential customer equal to the annual percentage increase in the overall contract for rubbish and refuse collection services between the City of Sheffield Lake and the service provider.
   (d)    Senior citizens and residents who are totally disabled should consult the Clerk of the Utilities Department as to any credits allowed them.
   (e)    All other increases in the monthly rate per residential customer for rubbish and refuse collection within the City must be approved by Council by appropriate ordinance.

965.04 ENFORCEMENT.
   The Mayor and the Director of Public Service are hereby authorized to prepare and enforce rules and regulations pertaining to collection of garbage and rubbish subject to approval of Council. Either official may do so.

965.05 SURCHARGES FOR DELINQUENCY.
   Penalties for delinquent payments may be charged as deemed necessary by the Department of Public Service.

965.06 INDEPENDENT REFUSE AND GARBAGE COLLECTORS.
   All persons, contractors, corporations and partnerships who are engaged in the private collection of rubbish and garbage shall register for collection of the same with the Director of Public Service. Such independent contractors shall make collections of refuse and garbage with an enclosed vehicle and in accordance with the rules and regulations for the collection of the same as may be prescribed by the Director. Such rubbish and garbage contractors shall, in addition to registering with the Director, obtain a permit for the collection and gathering of refuse and garbage for which they shall be charged a fee of fifty dollars ($50.00). In addition to the permits, the independent contractors shall be required to furnish to the Director proof that they carry sufficient liability insurance involving a minimum of one hundred thousand dollars ($100,000) coverage to a maximum of three hundred thousand dollars ($300,000) for personal liability, and twenty-five thousand dollars ($25,000) for liability against property damage. The requirement for obtaining such permits shall become effective on January 1, 1970. No permit or any other requirement for independent contractors engaged in the removal and disposal of rubbish and garbage shall be required before January 1, 1970.

965.07 FEE SCHEDULE FOR UTILIZATION OF DUMPSTERS.
   The fees to be charged for the use of dumpsters of the City for any and all dumping excepting there from chippable branches permitted by the City shall be as follows:
   (a)    For a non-station wagon passenger car: $7.50
   (b)    For a station wagon: $12.50
   (c)    For a minivan or miniauto pick up truck: $17.50
   (d)    For a full size truck or full sized van: $22.50
   (e)    For a doubleload truck: $37.50
