1385.01 PURPOSE; SCOPE.
   Any residence or lawful business located in the City may be equipped with an emergency alarm, for the purpose of detecting and signaling unauthorized intrusion, upon compliance with this chapter. Existing installations are subject to the requirements of this chapter, including those pertaining to permits. This chapter specifically does not apply to fire alarm systems. (Ord. 26-87. 1385.02 CONNECTION OF EQUIPMENT; PERMIT REQUIRED; APPLICATION; ISSUANCE; FEE.
   Any person wishing to connect emergency alarm equipment to the police station must first acquire a permit therefor. Upon proper application by any person to connect installed equipment to the City police station to receive emergency alarms, the Chief of Police or his or her authorized representative may issue a permit for such connection. The annual fee for such permit shall be as set forth beginning on June 1 of each year or any part of a year or any part of each year, below:
   Emergency Alarm Systems Permit (per year or part thereof): twenty-four dollars ($24.00)

1385.03 FALSE ALARMS.
   (a)    A charge of twenty-five dollars ($25.00) shall be assessed by the Chief of Police for each false alarm received through equipment described in this chapter, and for each false alarm received through any other alarm service which the City has given permission to be installed. Such fee shall be assessed against the holder of the permit for the alarm with which the false alarm is associated.
   (b)   A charge of twenty-five dollars ($25.00) shall be assessed by the Chief for each false alarm received by telephone from a central station or alarm company answering service. Such fee shall be assessed against the alarm company with which the false alarm is associated.
   (c)    Notwithstanding the fees provided for in subsections (a) and (b) hereof, no charge shall be made for a first false alarm and no charge shall be made for a false alarm to which there is no response by the Police Department or the cause for which is proven to be an act of God.
   (d)    Any charge for a false alarm as provided for in subsection (a) and (b) hereof, which remains unpaid thirty days after the date of invoice, shall result in the cancellation of permit required in Section 1385.02 .
   (e)    If a charge under this section remains unpaid thirty days after the date of the invoice, such fact shall be grounds for revoking or for refusing to renew or grant such a permit, and any direct connection to the equipment of the police station shall be terminated.
   (f)    No permit shall be renewed unless all payments due under this section are paid in full. (Ord. 26-87. Passed 3-24-87.)
1385.04 EQUIPMENT STANDARDS.
   (a)    All equipment used in installations for which a permit is required under this chapter shall meet the applicable standards of Underwriters' Laboratories and/or other recognized industry standards. An applicant shall submit evidence of the reliability and suitability of the equipment to be installed.
   (b)    The sensory mechanism used in connection with such a device shall be adjusted to suppress false indications of intrusion, so that the device will not be actuated by impulses due to transient pressure changes in water pipes, short flashes of light, wind noises such as the rattling or vibrating of doors or windows, vehicular noises adjacent to the installation or other forces unrelated to genuine alarms.
   (c)    All components comprising such a device must be maintained by the owner or lessee in good repair to ensure reliability of operation.

1385.05 INSTRUCTIONS.
   (a)    Each alarm equipment supplier that sells or leases an automatic protection device to a person, which is installed on such person's premises in the City, shall furnish that person with instructions as to the way the device operates, along with maintenance instructions.
   (b)    Each alarm equipment supplier shall also furnish the Chief of Police with a copy of the instructions as to the way the device operates. If the Chief finds such instructions to be incomplete, unclear or otherwise inadequate, he or she may require the alarm equipment supplier to have the same revised to meet his or her approval and then promptly have copies distributed to persons for whom installations of such devices are made.

1385.06 SERVICE.
   (a)    Each alarm equipment supplier that sells or leases an automatic protection device to a person, which is installed on such person's premises in the City, for which a permit is required, shall provide for receiving calls for service, directly or through an agent, on a twenty- four hour basis, seven days a week, and shall respond to such calls within eight hours of the time they are received. Such supplier shall notify the Police Department of any change of its address, telephone number and/or personnel.
   (b)    At the time of installation, each alarm equipment supplier shall furnish to the person for whom an automatic protection device has been installed, written information as to how service can be obtained at any time, including the telephone number to call for service, and such person is responsible for having the device repaired as quickly as possible after he or she learns, either from his or her own sources or from notification by the City, that the device is not working properly.

1385.07 INSPECTIONS.
   The Chief of Police or any officer designated by him or her may, at reasonable times and upon oral notice, enter upon any premises within the City to inspect the installation and operation of an automatic protection device or signaling device, the purpose of which is to report an emergency to the police station.

1385.08 REPAIRS.
   All equipment, the use or installation of which is subject to this chapter, shall be maintained in good operating condition. The Chief of Police may require that repairs be made whenever he or she has determined that such are necessary to ensure proper operation.

1385.09 REVOCATION OF PERMITS; NOTICE; APPEALS.
   For a violation of any of the provisions of this chapter, for failure to properly maintain an installation or when the number of false alarms for any installation equals ten in any twelve- month period, the Chief of Police shall serve written notice upon a permit holder of intent to revoke his or her permit. Such notice shall be given not less than seven days prior to revocation. Such notice shall state the right of the permit holder to appeal to the Mayor as the Safety Director. If an appeal is filed, in writing, the Director shall hold a hearing on the matter and shall render a decision on the basis of the facts presented. The Director's decision shall be final. If no appeal is filed, the Chief shall transmit all pertinent information to the Director, who shall cancel the permit. The Chief shall take whatever steps are necessary to disconnect the alarm.

1385.10 NONLIABILITY OF CITY.
   The issuance of any permit under this chapter shall not constitute acceptance by the City of any of its employees, officials elected or appointed, agents, representatives or any person, corporation or other entity acting for or on behalf of the City of any liability to maintain any equipment, to answer alarms or for anything in connection therewith.

1385.11 RULES AND REGULATIONS.
   The Chief of Police or his or her authorized representative shall make and enforce such rules and regulations as he or she may deem necessary for the enforcement of this chapter and for the proper determination and collection of fees and charges provided in this chapter.

1385.99 PENALTY.
   Whoever violates or fails to comply with any of the provisions of this chapter is guilty of a minor misdemeanor.
