1387.04 APPLICATION FOR PERMIT.
CHAPTER 1387 Ground Satellite Stations
1387.01 ADVANCED TECHNOLOGIES IN RESIDENTIAL DISTRICTS.
   Within the residential districts as defined by City ordinances, the following provisions shall apply to satellite ground stations or other antennas designed to transmit or receive radio or television signals to or from earth satellites.
   (a)    Such ground stations or antennas shall be for the personal use of residents and their guests only.
   (b)    Such ground stations or antennas shall contain no graphic message or advertising.
   (c)    Ground-mounted stations or antennas shall be considered accessory structures and shall comply with the following conditions and requirements:
      (1)    Such stations or antennas not mounted on the roof of a primary or accessory structure shall be located to the rear of the principal building or structure and shall not exceed an above grade height of twelve feet.
      (2)    Such stations or antennas shall not be located closer than ten feet to a rear lot line, eight feet from a side lot line, or one foot from any easement.
      (3)    Such stations or antennas shall be mounted in a concrete base in line with grade and only metal supports of galvanized construction shall be utilized.
      (4)    Wiring between such station and any other structure shall be placed underground.
      (5)    Such stations or antennas shall be designed to withstand a wind force of up to seventy miles per hour without the use of supporting guy wires.
   (d)    Roof mounted stations or antennas shall be considered accessory structures and shall comply with the following conditions and requirements:
       (1)    Such stations or antennas shall be mounted directly on the roof of a primary or accessory structure and shall not be mounted on appurtenances such as chimneys, towers or spires.
      (2)    Such stations or antennas mounted on the roof of a primary or accessory structure shall not exceed a height of greater than three feet above the roof on which it is mounted. The height shall be measured vertically from the point at which such station or antenna is mounted on the roof.
      (3)    The diameter of any dish antenna mounted upon the roof of a primary or accessory structure shall not exceed three feet.
      (4)    Such stations or antennas shall be designed to withstand a wind force of up to seventy miles per hour without the use of supporting guy wires. (Ord. 55-86. Passed 6-24-86.)
1387.02 ADVANCED TECHNOLOGIES IN NONRESIDENTIAL DISTRICTS.
   Within nonresidential districts as defined by City ordinances, the following provisions shall apply to satellite ground stations or other antennas designed to transmit or receive radio or television signals to or from earth satellites.
   (a)    Such ground stations or antennas shall contain no graphic message or advertising.
   (b)    Ground mounted stations or antennas shall be considered accessory structures and shall comply with the following conditions and requirements.
      (1)    Such stations or antennas not mounted on the roof of a primary or accessory structure shall be located to the rear of the principal building or structure on the property where the station is located and shall not exceed an above grade height of twelve feet.
      (2)    Such stations or antennas shall not be located within fifty feet of a public right of way, thirty feet of a rear or side lot line and not closer than fifty feet from a lot line of a residential district as defined by City ordinances.
      (3)    Such stations or antennas shall be mounted in a concrete base in line with grade and only metal supports of a galvanized construction shall be utilized.
      (4)    Wiring between such station and any other structure shall be placed underground.
      (5)    Such stations or antennas shall be designed to withstand a wind force of up to seventy miles per hour without the use of supporting guy wires.
   (c)    Roof mounted stations or antennas shall be considered accessory structures and shall comply with the following conditions and requirements:

1387.03 PERMITS REQUIRED.
   No person, firm, partnership, corporation, trust or other legal entity shall construct an earth station without a permit, nor shall construction commence before a permit is issued in accordance with Section 1387.04.

1387.04 APPLICATION FOR PERMIT.
   (a)    The owner or occupant with written permission from the owner of any lot, premises or parcel of land within the City, who desires to construct an earth station on the lot, premises or land parcel, must first obtain a permit to do so from the City Building Inspector and the Planning Commission.
   (b)    The Building Inspector and the Planning Commission shall issue such permit, provided the applicant submits a written application upon forms provided and approved by the Building Inspector along with a plot plan of the lot, premises or land parcel attached, showing the exact location and dimensions of the proposed earth station; a description of the kind of earth station proposed; the exact location and dimensions of all buildings or structures; construction plans and specifications prepared by a professional engineer, showing the elevations of the proposed earth station upon completion; and a structural engineering analysis. Each application shall specify among other things, the name and address of the owner of the real estate; the applicant; the professional engineer who prepared the construction plans and specifications; and the person to be permitted to construct the proposed earth station.
   (c)    The applicant shall present documentation of the possession of any license or permit required by any Federal, State or local agency pertaining to the ownership, construction or operation of an earth station.
   (d)    The applicant shall submit with each application the sum of ten dollars ($10.00) which represents the permit fee provided, however, no such permit will be issued for any commercial or industrial ground satellite station without the applicant first having obtained approval from the Planning Commission for the construction, erection or installation of such commercial or industrial ground satellite station and after such approval has been obtained the applicant obtaining the permit from the Building Inspector as set forth hereinabove. The permit fee shall cover the costs of reviewing the construction plans and specifications, inspecting the final construction and processing the application.
   (c)    The Building Inspector must notify by certified mail owners of real estate adjoining the property upon which the proposed earth station is to be erected at least ten days before issuing a permit. The applicant shall provide the Building Inspector with a list of all such adjoining property owners and shall pay to the Building Inspector a sum of money equal to the cost of the certified mailings required herein. The failure of the applicant to provide the Building Inspector with the correct names of the owners of adjoining property shall not create any liability on the part of the Building Inspector or the City. The failure of an adjoining property owner to be notified pursuant to this section if the applicant has not made the correct property owners known to the Building Inspector shall be the sole responsibility of the applicant and should any action be brought to attempt to set aside any permit issued to an applicant who failed to provide the Building Inspector with the names of all adjoining property owners and should such action result in a decision or settlement that the applicant deems to be unsatisfactory, such decision or settlement shall be the sole responsibility of the applicant. 1387.05 COMPATIBILITY WITH OTHER ORDINANCES.
   Any provisions of this chapter in conflict with any presently existing ordinances or resolutions of the City shall be interpreted to provide that such presently existing ordinance or resolution shall be in full force and effect and shall not be repealed or modified by these sections or portion thereof.

1387.99 PENALTY.
   Whoever violates any provision of this chapter is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
