311.07 TRAFFIC CONTROL IN CONSTRUCTION AREAS.
CHAPTER 311 Street Obstructions and Special Uses
311.02 PARADES AND ASSEMBLAGES.
   (a)   No person, group of persons or organization shall conduct or participate in any parade, assemblage or procession other than a funeral procession upon any street or highway, or block off any street or highway area, without first obtaining a permit from the Mayor.
   Applications for such permits shall be made on such forms as may be prescribed and shall contain such information as is reasonably necessary to a fair determination of whether a permit should be issued. Applications shall be filed not less than five days before the time intended for such parade, procession or assemblage.
   The permit may be refused or cancelled if:
      (1)   The time, place, size or conduct of the parade including the assembly areas and route of march would unreasonably interfere with the public convenience and safe use of the streets and highways.
      (2)   The parade would require the diversion of so great a number of police officers to properly police the line of movement, assembly area and areas contiguous thereto so as to deny normal police protection to the Municipality.
      (3)   The parade route of march or assembly areas would unreasonably interfere with the movement of police vehicles, fire-fighting equipment or ambulance service to other areas of the Municipality.
      (4)   The parade would unreasonably interfere with another parade for which a permit has been issued.
      (5)   The information contained in the application is found to be false, misleading or incomplete in any material detail.
      (6)   An emergency such as a fire or storm would prevent the proper conduct of the parade.
   The permit or any order accompanying it may limit or prescribe reasonable conditions, including the hours, the place of assembly and of dispersal, the route of march or travel and the streets, highways or portions thereof which may be used or occupied.
   (b)   Whoever violates this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
311.03 TOY VEHICLES ON STREETS.
   (a)   No person on roller skates or riding in or by means of any sled, toy vehicle, skateboard or similar device shall go upon any roadway except while crossing a street on a crosswalk and except on streets set aside as play streets.
   
   (b)   Whoever violates this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
311.04 ZONES OF QUIET.
   (a)   Whenever authorized signs are erected indicating a zone of quiet, no person operating a motor vehicle within any such zone shall sound the horn or other warning device of such vehicle except in an emergency.

   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
311.05 PLAY STREETS,
   (a)   Whenever authorized signs are erected indicating any street or part thereof as a play street, no person shall drive a vehicle upon any such street or portion thereof except drivers of vehicles having business or whose residence are within such closed area and then such drivers shall exercise the greatest care in driving upon any such street or portion thereof.

   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
311.06 BARRICADES AND BARRIERS.
   (a)   No person shall obstruct or maintain any obstruction upon any public street, alley, right of way or public grounds without first obtaining permission to erect such barrier, obstruction or barricade from the Chief of Police or his designated representative.
   (b)   Such barrier or barricade so used shall be of a temporary type constructed of wood or similar material, shall be of a height of not more than four feet and shall be capable of being easily removed for the passage of emergency vehicles or traffic. Such barricade shall be properly and clearly marked and proper warning lights or devices provided for during the hours of darkness.
   (c)   The Chief of Police and the Fire Chief, or their designated representatives, are hereby authorized to summarily remove any obstruction upon or blocking any public street during the answering of an emergency or public safety call.

   (d)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
311.07 TRAFFIC CONTROL IN CONSTRUCTION AREAS.
   (a)   Whenever the ordinary and usual flow of motor traffic, in the opinion of both the Service Director and Safety Director, within the municipal and corporate limits of the City is substantially impeded as the direct and proximate result of construction or utility being performed by a private general contractor, the City shall require that traffic control on said roads, at such times as the ordinary and usual flow of motor vehicle traffic is substantially impeded, be performed by a uniformed, off-duty police officer on an individual personal contract basis with the general contractor. The determination as to when such uniformed off-duty police officers shall perform such duties shall be in the sole discretion of the Service Director and Safety Director.
   (b)   In the event no uniformed off-duty police officers are available to perform the above-described traffic control during the times such traffic control is required, the foregoing requirement to have uniformed off-duty police officers of the City perform such traffic control services shall be deemed and considered to have been fulfilled and other available traffic control services may then be utilized and shall then be utilized in the sole discretion of the Service Director and Safety Director in order to protect and maintain the public safety in such areas as are then substantially traffic impeded.

   (c)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
