961.11 COMMERCIAL ENTERPRISES.
CHAPTER 961 Parks, Parkways and Playgrounds
961.03 INJURY OR DESTRUCTION OF PROPERTY, VEGETATION, ETC.
   (a)   No person shall injure, deface, destroy, disturb or remove any part of a park or building, sign, equipment or other property found therein, nor shall any tree, flower, shrub or other vegetation or fruit or seed thereof, or rock or mineral be removed, injured, destroyed or disturbed.
   (b)   Any person who violates provisions of subsection (a) of this section shall be guilty of a first degree misdemeanor and shall be required, in addition to any other penalty, to make restitution for any such injury, defacement, destroying, disturbing or removing caused by them. 961.04 LITTERING; NOXIOUS MATERIALS.
   No person, without the specific written consent of the Director of Public Service, shall bring into, leave behind or dump any material of any kind in a park except the refuse, ashes, garbage and other material of a picnic, camp or other permitted activity, provided that such material is deposited in receptacles or pits provided for such purposes.
   No person shall either within or outside of a park, discharge into any pipe, drain, sewer, ditch or natural tributary watercourse that flows, through or onto park lands, any liquid or aqueous waste or any noxious or deleterious material which may render park waters harmful or inimical to the public health or to animal, vegetation or aquatic life, or which may prevent, limit or interfere with the use of such waters for domestic purposes, or which may lessen to an unreasonable degree the use and enjoyment of such water for park lands or for recreational or other park uses. 961.05 FIREARMS, FIREWORKS AND EXPLOSIVES.
   No person, except a police officer or other law enforcement officer, shall carry an air or gas gun, sling shot, or missile throwing device within a park, or discharge any fireworks, explosive substance or air or gas gun. A lawful firearm may only be discharged in an act of self-defense in the face of deadly force.

961.06 INDECENT CONDUCT AND EXPOSURE.
   No person shall appear in a park in a state of nudity, or commit, perform or engage in any lewd, lascivious, obscene or indecent act or behavior and no person shall make any indecent exposure of his or her person.

961.07 DISORDERLY CONDUCT.
   (a)   No person shall disturb the peace and good order in a park by fighting, quarreling or wrangling with a loud voice or shouts, threatening violence to the person or property of others or engaging in riotous clamor or tumult.
   (b)   No person shall collect with two or more other persons in bodies or crowds for unlawful purposes or in riotous assemblage or with the intention to annoy, harass or inflict property damage or bodily injury upon another person or persons.
   (c)   No person shall beg, hawk, peddle or solicit within a park.
   (d)   No person shall willfully assault or commit bodily injury upon another while within a park, or be engaged in, or abet or aid in, any fight, quarrel or other disturbance.
   (e)   No person shall play games of chance or drink, sell, possess or offer for sale any intoxicating liquor, except where especially permitted by the Park-Recreation Board, or be under the influence of alcohol or any drug of abuse within a park.
   (f)   No person, except a police officer, shall have or carry any switchblade,    hunting knife, dagger, metal knuckles, slingshot or other dangerous weapon concealed or about his person while in a park.
   (g)   No person shall use obscene, profane or abusive language while in a park.
   (h)   No person shall loiter in or near toilet buildings.
   (i)   No persons, except park maintenance employees on duty or police, shall enter a toilet room set aside for the opposite sex.

961.08 ADVERTISING AND SIGNS.
   No person shall expose, distribute or place any sign, advertisement, circular, notice or statement or display any banner, emblem or design within a park without a specific permit from the Director of Public Service.

961.09 COMPLIANCE WITH ORDERS OF POLICE.
   No person shall fail or refuse to comply with any reasonable order relating to the regulation, direction or control of traffic, or to any other order lawfully given by any police officer, or willfully resist, obstruct or abuse any police officer or other official in the execution of his office.

961.10 CAMPS AND CAMPING.
   No person shall establish or maintain any camp or other temporary lodging or sleeping place within a park without a specific written permit from the Park-Recreation Board and Director of Public Service.

961.11 COMMERCIAL ENTERPRISES.
   No person shall sell or offer for sale any article, thing, privilege or service within a park without a permit from the Park-Recreation Board and Director of Public Service.

961.12 FIRES.
   No person shall start a fire in a park except small fires for culinary purposes in park grills, privately owned grills or fires in the places or designated areas. The Director of Public Service and/or the Chief of Police may, at his discretion, prohibit fires for limited periods at any location or for any purpose when necessary for the protection of park property. All fires shall be put out by the person starting or using the same before leaving the immediate vicinity of the fire. The dumping of hot ashes or fire from portable picnic grills onto the grass or plants is prohibited.

961.13 HOURS OF CLOSING.
   No person shall be permitted to remain, stop or park within the confines of a park or parkways within the City of Sheffield Lake, Ohio outside the hours of operation of the    parks as determined by the Park Recreation Board. The set hours of operation of parks and parkways within the City of Sheffield Lake may be varied only by a special permit issued by and obtained from the Park Recreation Board and Director of Public Service. Such special permit shall be for a particular time period and shall be issued only upon request and upon the submission of an application of a type and kind to be established by and approved by the Park Recreation Board and Director of Public Service, and only if the request is approved by the Mayor. 961.14 HUNTING, FISHING AND MOLESTING WILDLIFE.
   No person within the confines of a park shall hunt, pursue with dogs, trap or in any other way molest any wild bird or animal found within the confines of a park, or rob or molest any bird nest or take the eggs of any bird. The Park-Recreation Board may cause such park waters as it deems advisable closed to fishing and shall so post them. In all other park waters fishing shall be permitted subject to the statutes of the State, except that    the use of bows and arrows for fishing is prohibited, and fishing shall not be permitted during the hours a park is closed. 961.15 HOUSEHOLD PETS.
   No person shall bring into, permit, have or keep in a park any dog, cat, household pet or other animal destructive to birds and other wildlife. Dogs or cats are permitted if they are controlled at all times on a leash not more than eight feet long, except that dogs are    permitted to be unleashed only in designated enclosed dog park areas.

961.16 SWIMMING, SWIMMING AREAS AND BEACHES.
   (a)   Swimming is prohibited except in areas designated for that purpose by the Park- Recreation Board.
   (b)   Fishing is prohibited in designated swimming areas.
   (c)   Boats, jets skis and similar motorized watercraft are prohibited within the designated swimming areas.
   (d)   No glass bottles or metal cans are permitted on the beaches adjacent to or in swimming areas.
   (e)   Cats and dogs are prohibited in all swimming areas and beaches.

961.17 BOATING.
   The provisions of Chapter 557 of this Code inclusive, relating to watercraft regulations shall be effective and enforced.

961.18 BOWS AND ARROWS.
   The use of bows and arrows in a park is prohibited.

961.19 TRAFFIC.
   (a)   Purposes of Way. No person shall use any portion of a park for purposes of way except drives, roadways, paths, walks and trails established for such purposes.
   (b)   Speed Limit. No person shall drive or propel or cause to be driven or propelled along or over any road or drive within a park any vehicle at a greater rate of speed than ten miles per hour.
   (c)   Reckless Driving. No person shall operate a vehicle along or over any road or drive within a park in a reckless manner or without due regard for the safety and rights of pedestrians and drivers and occupants of all other vehicles, so as to endanger the life, limb or property of any person while in the lawful use of park drives or roads.
   (d)   Mufflers. Every motor vehicle with an internal combustible engine shall at all times be equipped with a muffler in good working order and in constant operation. No person shall use a muffler cutout, bypass or similar device upon a motor vehicle in a park.

961.99 PENALTY.
   Except as otherwise provided, whoever violates any of the provisions of this chapter shall be fined not more than five hundred dollars ($500.00) for the first offense nor less than five hundred dollars ($500.00) for each subsequent offense and shall pay for damages to park areas in addition to the fine.
